Guest guest Posted January 18, 2012 Report Share Posted January 18, 2012 From Eleanor : if the authority decides to issue a statement it should be within two weeks after the assessment, and the LEA have 8 weeks to finalise. So: They've got ten weeks to assess, then they send a letter saying they've agreed to assess, count down eight weeks from that letter to finalise and hold them to all timescales. That ten weeks is a statutory timescale, and if they muck you about without good reason, dragging their heels and generally being a pain, you might want to remind them that you could opt to take them to judicial review in order to hold them to the timescales. The funding for a JR is funded for the child by legal aid on their account the last time I checked, so you might want to check that very last point with a solicitor if things get sticky. Some people I know have had to resort to that (unwillingly) because in one case,for instance, they left that child without schooling for 18 months.
