Im sorry to hear that. That is discrimination I feel. Fight this and I hope they

will give you the key so your daughter can get around school.Can she use a wheel

chair? I'm guessing she is using one now.

The Americans with Disabilities Act is well known and they are discrimating

against your child. That's unfair. The school better get their act together.

Hi

My daughter does not a WC. I think if she needed a WC people would be

more understanding. Right now she just looks like every other kid but she walks

much slower.

Ok Just trying to understand here ok. Im sorry that she is going through that.I

use a wheel chair when I need to get around like at a mall.Would she be open to

using one so she can get around faster.Thats just a thought I have. My left

ankle bothers me and get painful.I have CMT 1X.

Yes it can be very frustrating as my son has similar issue. Everyone says

what is the big deal he can walk but it is very difficult especially with

stairs and crowds of kids. Next year we will face the second floor school

issue and they thankfully do have an elevator and it is my understanding

that he will get a key. He of course wants to do the stairs with the other

kids but wants extra time to get to class. That may work. Time will tell.

But I do not think a child should have to use a wheelchair just to get the

help they need and deserve.

I was just giving my feelings. You are right about using a wheel chair. I was

just giving a sugestion and thats all.

All kids who have a disabilty want to fit in and be accepted and sometimes its

hard because kids who have disbilties have to go through stuff like this.Schools

do not or they do not care.Keep fighting.

When I was in 8 th grade I told my teacher I wanted to get retested and they

did.I have a learning disabilty too.They put my in a mentally handicapped

classroom and the work was easy for me so I had to fight to get retested and

they did and they put me in another school where the work was harder for me.

Your kid should get extra time to get to the classroom. They need to understand

that.Can you get a doctors note, would that help?

Hi ,

I have several doctors notes for the elevator use. Yesterday the

attorneys filed for due process. Looks like the court will decide.

That would be wonderful if out of this came something so wonderful.

I hope it also changes how the " school district " treats kids with

disabilities.

The district keeps saying that an elevator key is not " educationally

necessary " . It is my belief that they have misinterpreted the law. They have

also locked up all but 1 handicapped spot. Well they have two spots but one is

always occupied by a staff member. It can be so discouraging.

I really admire you for fighting for your kids. You've got the best lawyers in

L.A. and I'm sure they'll come through for you. As I see it, it is simple. Just

give her a key to the elevator so she can have * acess * to the 2nd floor and

her classes. Apparently, the school doesn't get the concept of what true

accessibility is. But with the Firm, they will. Who knows? Your case may set a

predecent for other cases.

Hi R,

Well when my two sons were in school they both had elevator keys and both were

labeled as OHI and the school district knew that they had CMT. So I would look

in to some laws in your state and try to decipher and help them to see their

wording means exactly what you need...for example " to have access to the

elevator " the only way for it to be accessible is to have a key.

I really had a hard time understanding the logic of the school district in

this matter, until I saw Gretchen's post and realized lived in Los

Angeles. The LAUSD (Los Angeles Unified School District) is famous for

irrationality, recently spending millions to build a high school they can't

afford to staff in a neighborhood where there are no students (downtown).
