It's the non DoD schools that MUST abide by DoD reg's for the education of children that are dependents of those in the military. The biggest 'plus' to this is that when in Due Process the Pentagon Attorneys will represent the parents. In 2003, I was approved to Advocate for those on bases globally. The counsel for the DoD (which comes from the Pentagon) has me start the case and move it rapidly forward to 'Pre-Hearing'. Once the Pre is underway I'm already instructed to introduce the case and immediately withdraw myself from it with a 'Motion' that replaces me with the attorneys (They send 2) from the pentagon to replace me as generally they don't want me to represent a dependent of a DoD family in an actual hearing. DoDDE schools are across the globe on bases and have a strict requirement not only for early intervention but as well to educate up to age 21. s law has information regarding the provision of ABA programs for those military families that are interested. Most of the time parents will let their C.O. know about the problem and they will contact the Pentagon directly and the case moves forward without an Advocate. On Oahu where I am most of the time we have so many bases and no DoD schools so it's much different. Once these non DoD Schools find out that the case involves a dependent of a military family they back down fast. I do the IEP's and they go very smoothly, but in some cases I do have to turn it over. I hope this helps as many aren't aware that by serving the country their dependents have a complete set of reg's that go along with IDEA if they have a disagreement in an IEP. FAmilies who are in the military are often at a loss and we, " civilians " do not have information about services available. A fact sheet, where to go for information, etc would be wonderful.
