Hi All,

I am the angry parent that lives in one of these districts. We are going through

the 2nd time Zeb has been arrested. Some states have laws that can require the

courts to monitor the schools but most do not. They are entirely two separate

entities. The criminal system has less regard for children with disabilities,

again, some states better than others. Although all of the alleged incidents

occurred at school and not under my supervision I am the responsible party. The

only recourse after going through the criminal courts is to address the school

issues. Zeb was found not competent the first time he was arrested so the state

could not proceed with a trial. The school is pushing the issues beyond

comprehension by asking for protective orders. The school actually pursued the

charges two weeks after the alleged incidents(I do not believe anything they

reported is true) after I refused to consent to a punitive BIP in a PPT meeting.

Zeb already had a BIP that

the school never implemented. They actually said in a taped meeting that he

didn't have a BIP. I produced the document. The PPT also had a very long list of

alleged behavioral issues that I was hearing about for the first time. Zeb has a

daily communication book that was never used to report such behaviors. I have an

email address listed and a home and cell phone. I never received any complaints.

The school pressed charges as a retaliatory measure against me.  Since I filled

due process this spring, Zeb has been suspended many times. The record will

reflect the timelines. Zeb would suffer with a punitive BIP moreso than he will

with criminal charges. I was well are that if I didn't agree he would be

arrested. The police called the following morning at 10. It would take months

and an act of congress to change a BIP if I had agreed but would cost me a

bundle if I didn't. I had to weigh the risks. I was stuck between a rock and a

hard place. I hope I made

the right decision and hired the best attorneys.

Zeb choose pizza for supper and I made him a cake.I gave him his lactose pills.

He rarely cheats with the dairy.  Pete and I sang him happy birthday and Zeb

blew out his candles. I bought him an MP3 player. He had no idea what it was and

didn't seem very impressed. I will show him how to use it this week. Zeb will

have his big family party on Saturday. He reminded me tonight that he is going

to be 17. I will hear this for the next year. He asked for a car!

<<Children With Disabilities Arrested For Behavior>>

Hi, Everyone.... you know what's the scary part? It is that these were

school related incidences. Teachers are suppose to follow IEP's, that are

suppose to have BP's for kids that need them, and they are suppose to prevent

these

sorts of incidences. There are just some schools/teachers/ districts out

there that just don't' give a d@# & about the student. Our % for bad schools was

1/6 concerning G's schools..... that is an awful high number if it represents

the schools across America!!! The bad districts just want the gov'ts $$$ and

could care less about the kids. We had the *privilege* of living in such a

district and, as many of you already know, Gareth was *charged* at the age of

7 for kicking his aide in the shin ---even though there was no mark of proof

that he did it. It is scary....like Holly said....what' s going to happen to

the 1/150 when they reach the teenage yrs? Sorry for the

anger......personal subject here!!!

Take care, Everyone.

Margaret

Charlyne, Please give Zeb a big birthday kiss for me and a big hug.

Oh hun I am sorry you are enduring all of this. This makes me mad

and I do understand. Just as they are not protecting him and helping

him to keep him from getting arrested has suffered from school

bullies. Instead of kicking these kids around they need to spend the

money to get Behavorial specialist to work with behavior problems. All

of the kiddos at 's school are wards of the state and so there is

no one at home to work on behavorial problems.Nevertheless the

problems need to be addressed were most of the problems are occuring

and in your case it is at school. I do not blame our children I blame

our school systems for whom these kids spend the most time. We have

an attorney and the schools are protected against just about anything

they let happen at school. If your child repeatedly gets hurt at

school the school district here is not responsible. Bull shit. We are

resposible for our children but not when they are at school in my

opinion.Espeically when our children are not typical children that

you can reason with. I wish you all the luck in the world with your

pursuit. I wish Zeb a wonderful Birthday. So he wants a car so do

like they do my FIL one year they bought him a toy truck. Cyndi b

Hi Miss Charlyne, this is Leilani, I was reading your post and I wanted you to

know that I will  be praying for you.  My heart hurts at the thought of your

child being used like that.  I worry about Noah in the same way, and the school

knows that I am always going to be on their ass so I worry about it being taken

out on my son.  I dont know what I would do if I was in your shoes, but I will

be thinking of you and your family.  I wish you the best.  Take care and good

luck.  Leilani

Happy Birthday Zeb! While life has been far from easy the last

several years with issues surrounding . I am glad that our area

police dept.s have felt that charges were inappropriate and that we

have a school district that does what it is supposed to.

When was still living at home I remember having to restrain him

while at a local festival. I was afraid that someone was going to

think that I was hurting him and asked someone to send a police

officer from the festival over. The officer came over and stood

quietly by recognizing that his intervention would not settle the

issue but increase the agitation. He got our info at the end and we

went home.

we are fortunate to have educated law enforcement agencies in our

area and schools that do there job for the most part.

good luck and my thoughts are with you.

<<Children With Disabilities Arrested For Behavior>>

Hi, Everyone.... you know what's the scary part? It is that these were

school related incidences. Teachers are suppose to follow IEP's, that are

suppose to have BP's for kids that need them, and they are suppose to

prevent these

sorts of incidences. There are just some schools/teachers/ districts out

there that just don't' give a d@# & about the student. Our % for bad schools

was

1/6 concerning G's schools..... that is an awful high number if it

represents

the schools across America!!! The bad districts just want the gov'ts $$$ and

could care less about the kids. We had the *privilege* of living in such a

district and, as many of you already know, Gareth was *charged* at the age

of

7 for kicking his aide in the shin ---even though there was no mark of proof

that he did it. It is scary....like Holly said....what' s going to happen to

the 1/150 when they reach the teenage yrs? Sorry for the

anger......personal subject here!!!

Take care, Everyone.

Margaret
