We now know they are planning to implement them in September of 2012 following a notice to families 30 days in advance. We also know that they did not accept our proposal to have DPW bill families for the copays rather than have providers do it. What we don’t know is whether they have accepted our proposal to deduct families’ out-of-pocket costs when calculating family income to determine whether the family has to pay copays (only families with countable income at or above 2x the federal poverty level have to pay) or, if so, the total amount in copays a family has to pay in a month or quarter (federal law limits the total aggregate amount of copays for any family to 5% of their countable income- but the state gets to decide how that income will be counted). We also don’t know how they intend to compile the amount each family has spent on copays to all providers in order to determine when a family can stop paying copays or how they will notify providers when the family no longer has to pay copays.Families are still encouraged to write to DPW regarding the deduction of out-of-pocket costs.
