In v. Bixby ISD 4 (10th Circuit, Tulsa County, Ok, 1990) the

> court confirmed as follows:

> Regression-recoupment is not the only measure used to determine the

> necessity of

> an ESY program. Other factors include “the degree of impairment, the

> ability of

> the child’s parents to provide the educational structure at home, the

> child’s rate of

> progress, his or her behavioral and physical problems, the availability of

> alternative resources, the ability of the child to interact with

> non-disabled

> children, the areas of the curriculum which need continuous attention,

> and the

> child’s vocational needs.”
