Hi Ang:

I think the statute can continue up to the point of realization of implant illness (documented by a physician) and not the surgery date itself--but call an attorney in NY to find out.

This is so infuriating because you are not ever supposed to have any

procedure, surgery, test done without signing a consent. If the consent was

signed after the surgery, then your doc did the surgery on you without your

full informed, written consent. Do your records reflect that he didn't have

your consent prior to surgery? Typically docs will write in their notes

that the " surgery was reviewed with risks and complications, and written

consent was obtained. "

But how totally frustrating! Not to mention illegal on the doctor's part.

I know that other women have had this same thing happen to them. My

question is: where are their (your) rights? You should have something to

fall back on legally, and you do if you found the right lawyer to fight for

you.

what he wrote in his notes?

Hasn't the statute of limitations ran out? It was done on 11/22/98.

Thanks, I have an attorney in mind that was working with me on getting him when I lived in NY but I didn't follow through with it. I am going to call them if they will listen to me. I feel pretty bad that I flat left them.

Unfortunately it is probably past the statute of limitations, I think it is for me as well, does anyone know what the statute is?

Yep that was me too, one week after the surgery I was consented and even

then I just signed didn't read it, didn't go over it, what a freaking joke,

really pathetic.

Yes tell us how long we have to sue I only signed a surgical consent, the

one that explains the risks of anesthesia etc at the surgical center, it was

an op consent. The implant consent was not signed till one week later after

my implants were in me .

so what can I do now it has almost been 3 years.

I am so pissed, but I Know he would say he discussed them and just the

signing was overlooked, so I know I wouldn't get anything, I just know how

they operate, now if my implants are infected, well then that might change

something as far as the manufacturer or the PS error or something right?

The statute of limitations varies from state to state, but is generally 2

yrs from the date of onset of problems. However, because this is dealing

with a consent issue, there may be ways around that law.

For those of you who have a consent issue, I would seek out an attny who

does free consultations and see what he/she has to say. An informed consent

is an absolute must for any surgical procedure, and obtaining it only

documents that you did give the doc informed consent to do the surgery, that

he/she explained in detail the surgery, risk, complications to you, and that

your questions were answered satisfactorily. However, if the consent is

dated after the surgery, you can always say that your questions were not

answered to the full extent you would have liked them answered, and to this

day, you still have unanswered questions (this is true--don't we all?) It

is unethical and possibly illegal to do a surgery without a consent signed

and dated BEFORE or ON the day of surgery. If it's dated after the surgery,

I would definately pursue that. Also, , it might be worth it for you

to get your med records and see if your implanting ps documented before your

surgery that you had signed a consent, because if he did, and you have the

proof that you signed the consent after the surgery, that is also something

to pursue.

I would definately check out an attny who has free consultations and see

what he/she says. It can't hurt....

Well the question I have is this, I was consented for the surgery, there are

2 consents, there is the anesthesia and surgical risks consent that I signed

at the surgical center, which was went over by the anesthesiologist, this

was risks of anesthesia and surgery itself, this I understood, agreed to and

signed, not a problem, these risks I have always been very aware of,

however, the implant consent, that is the one that was never ever gone over

with me, it was just not done, even when I signed it, it had been a week

later, I was ill, in pain, on percocet and vicodin and not really even aware

of what I was signing, only reason I even signed it was because I asked my

ps " by the way what brand implants are these? " duh I was so ignorant I just

wanted my breasts to look normal I wasn't educated on anything but the

acutal surgical part of the procedure, I had no idea at all about the

implants themselves, I was just in fantasy land thinking that it would all

be wonderful, I would look like the pretty victoria secret girls, and yeah,

I did in my clothes, I was like a model or something, anyhow I am rambling

but the way this all went down was bad, totally bad, I think my PS knows it

too, he even admitted to me that yes, he had one other patient who explanted

from illness, he said she later came back to him and wanted to reimplant,

but never followed through, who knows. I know another girl who had her

breasts done by him and she is happy, healthy, a double D and is perfectly

fine at least now, so again, who knows, why me is what I could say all day

long, but in the end it doesn't change anything, so I just have to move on

and accept that I was not meant to have implants.

I still think I could have a case, I spent a ton of money on this nightmare

and it would be nice to have even just a part of the $$$$$$ back.
