Guest guest
As far as I know, it's not legal for an ER to turn anyone away. I would be contacting a lawyer. Or the ACLU. Anne -- Refusal to hospitalize autism Is it legal for an emergency room to turn away a 20 year old with autism when he is a danger to himself and others???? Well, Baylor in did just that on Friday. The reason- " because he has autism " !!!!!!!!!! They did not refer the family anywhere else. The family's thinking about contacting Dallas Morning News and asked me to post for recommendations. Thanks for any insight/resources. Guest guest
I would skip the media and go straight to an attorney- I'm sure they can sue under the Americans with Disabilities Act... IF this is truly what happened. If they recommended that the person with autism be seen for psychiatric evaluation at another facility, that might be another story. Was it clear that the person was a threat to himself? To others? Anne wrote: As far as I know, it's not legal for an ER to turn anyone away. I would be contacting a lawyer. Or the ACLU. Guest guest
It didn't used to be legal to turn anyone away, but I heard recently that this has changed. Hospital ERs no longer accept persons with mental health who are in " crisis " . I'm not sure how it changed or when this was approved, but this kind of situation would be a perfect one to alert your legislators and the governor about ESPECIALLY since all agencies were told to prepare their budgets at 10% lower than they were in the last two year cycle. You really need to get the governor's health aide on the phone and give her an earful about this. Pointedly ask people " Does someone have to die for a change to be made on this policy? " I think the person who recommended the 10% cut must have delusional disorder (if there is such a thing.). And if that person is THAT delusion, they have no business making public health policy for one of the biggest states in the country! There is absolutely no way with rates of mental health diagnoses on the rise that agencies can really cut their budgets by 10%. , I'll put something on the advocacy page. S.
