Contact a social worker immediately and find out her rights. Also, you might contact the ombudsman for the elderly as to her rights as well. The NH made my husband go to the hospital to have meds adjusted and then indicated they wouldn't take him back. The social worker told them in no uncertain terms that they had to take him back or find a place that was suitable for him and to my satisfaction. They dropped it. Don't go quietly into the night on this. June C. I found a Pro Bono Elder Care Attorney at our Senior Community Center that is very helpful and offers his advice monthly. Sherry, my husband's room has two other men that snore loudly, plus Jim has a mattress compressor to prevent bed sores and now an oxygen machine that all make noise. I'm reviewing patients' rights for the state and King's own declaration. .. I'm wondering, in the case of LBD, if a resident is saying things that can be construed as threatening, and since such statements are a manifestation of their disease, would it follow that her symptoms aren't being appropriately managed? Also, I believe her right to sleep (not specifically outlined anywhere but I would assume it is a given) was violated when she was put into the room with the noisy woman on the mattress with the air compressor. For all these weeks my mom hasn't been able to get a good night's sleep because of the noise - that would make ME say things I didn't mean, let alone someone with dementia who isn't able to verbalize exactly what her issues are! A symptom of the disease is the inability to use language appropriately, after all, and I believe she was expressing her frustration with the situation using inappropriate language, nothing more. I will ask who actually heard my mother " threaten to kill " her roommate, and what her exact words were, also. I believe that perhaps a medication adjustment may be in order, but I do NOT believe my mother is a danger to anyone. As I said earlier, I think there is more to it than this and I hope that (admin) and I can discuss it reasonably, and I can find out. BTW, the nursing home that has the " lock-down " unit where wants to send my mother has had 6 deaths in the last 5 weeks (per the obits in the county paper, there could be more), and when I checked at the medicare/medicaid website I saw that they had THIRTY!!!! health violations at their last inspection!! !!!!! Any other NH's anywhere in a 50-mile radius had maybe 6 or 7 minor ones. I don't want my mom to go there - but now that she's been " branded " as potentially violent her options will be severely limited... I just have to calm down and take one step at a time here, I think...any words of advice or wisdom will be GREATLY appreciated, as my " bamaged drain " is really having a hard time putting things in perspective.
