You have to have about 7% of your income in medical bills, the things done may not have to be prescription drugs, but do have to be prescribed by a physician. I really don't know more than this. We have a note from our doctor that my son requires to be on special diet and we have been doing this for the last 2 years (in addition to everything else that was mentioned already). In our case this is because as I mentioned we have a note from his medical doctor that the special diet is important part of his medical treatment. Also, for those of you who are using homeopathy - it can be claimed as medical expense if you have a note from MD or OD (Doctor of Osteopathy) that it is required. We got a note from our osteopath that he recommends homeopathy. All these advices we got from our tax guy - he has also child with special needs and taught us all ways how legally we can submit for most of our expenses. The only trick is to keep all your receipts, in case you get audited. Guest guest Posted February 17, 2011 Report Share Posted February 17, 2011 We have had an au pair in our home for years and will continue to need one not so much for daycare as the oldest is 13 and the twins are 7--there would be cheaper options for after school and summer care than an au pair. However, we need a dedicated driver and helper with the morning and early evening supplements/Rx/Special diet, getting him to private therapy and medical appts daily after school, assisting with self-help skills and preventing wandering and sibling abuse (my little guy on his twin sis), etc because both of us work full time and need this level of help to do our jobs and keep some sanity. I asked my au pair how much of his time was spent on my son's medically related care and he said 50% (which is what I estimated). I double checked my interpretation through HR block " ask a question " , and indeed the specialist agreed I can dedut the medical care portion of my au pair cost (which vastly exceeds the piddly 5k flexible spending child care max). So, 1/2 of the 23K expense is going on my medical (and we well exceed the 7.5% AGI +flexible medical benefit threshold.) I don't calculate the special foods--I have a big enough project adding up the various in and out of network services and deducting reimbursement amounts from insurance. But I do add up supplements listed in my Dr treatment notes, and add up the # of visits X RT mileage to calculate medical mileage. Medical milage reimbursement for 2010 is a mere 16.5 cents per mile but it still added up to over 2k in mileage and tolls. I count airfare to and conference fees for the LIA conference, too! Just have to make sure I have all receipts and they are all eligible as medical per the rules.
