We had hoped that he could be in the total communication classroom for a.m. preschool and p.m. kindergarten and then repeat kindergarten the following year. 's teacher said that she has learned of more HI kids and things are changing and there may not be room for during both the morning and afternoon even though that might be ideal for him. Hmmmmm..... can they do that? Accept more kids and as a result prevent one who is already there (and communicates only in sign language) from being in a signing classroom both a.m. and p.m.? It's called FAPE (Free and Appropriate Public Education) with an emphasis in 's case on the Appropriate. You might want to remind them of 34 CFR (Code of Federal Regulations) sec.300.522 which states that the child's program be based on the child's unique needs rather than the programs available. If a program that meets your child's need does not exist, the school is required to secure a program by , for example, starting a new program, modifying an existing program, providing an interdistrict transfer or paying for a non public school placement as appropriate. and 34 CFR Part 300, App C, No 4 which says: School districts MUST provide educational services based on the educational needs of the child. School districts cannot use economic issues to deny your child the services he needs. 34 CFR 300.1 : To ensure that all children with disabilities have available to them a free appropriate public education that emphasizes special education and related services designed to meet their unique needs and prepare them for employment and independent living; If after this they still say they can't or wont do it you do have the right to Due Process...
