The question itself is not discriminatory. it is the actions afterwards

that would determine if any discrimination is valid.

But I would say I am eligible to retire in two years.

I don't know if it would be discrimination to ask that of a PRESENT employee.

If it was asked in regard to a possible promotion... probably... and maybe

even if it was asked at all.

It certainly can't be asked of a PROSPECTIVE employee.

Our applications ask for a date of birth only if you are under the age

of 18.

I don't think it's against the law for a supervisor to ask your age AFTER

you've been hired. (Heck, I asked my supervisor her age the first meeting I

had with her - she's just a young thing, hasn't seen 30 yet). Could it have

been asked because the supervisor was working on a long term plan for the

comm. center and wanted the information to include in the report that X

number of employees were elibible for retirement in that period?
