Most of the time, those claims appear to be rejected. I think your best bet is pursuing the MDL settlement. Do you have an attorney? Guest guest Posted October 27, 2006 Report Share Posted October 27, 2006 Terri, If you had Bristol implants, your settlement would have to first come from the MDL, then if there are any $$$ left in the Dow Settlement, any amount you would have or should have received from MDL will be subtracted from anything you could receive from Dow. So, first you MUST try to collect any injury damage from MDL prior to trying to get anything from Dow. And the odds are that nothing will come from Dow for Bristol implant survivors because of the amount they receive or should have received from MDL. You must make every effort to collect from MDL anything due to you. That is my understanding. I think you should really try to get your attorney to get a handle on what the rules are. And who knows if we will ever get anything from Dow. And I almost died from my Mentor implant. It was not the cancer that got me, it was the silicone. Anything you would have gotten from Dow would have been subtracted anyway, so work hard to get what you can from the MDL. It is basically the same difference, except that you could actually stand to get twice as much from MDL as you would ever get from Dow. Benefits are reduced to about half in Dow over the MDL. Just submit the same packet to the MDL. Be sure it is complete. KKJ at toxicdiscovery.com can help you if you do fire your atty., but be aware he may get paid anyway. That is often how it goes.
