My surgeries were in 1997 and 1999... and my records are "missing." (They've been missing since 2000.) This hasn't seemed to be a problem with the doctors I've consulted with over the years. They do prefer records, but if you don't have them -they can get over it if they want to!

This is Florida but has links to other state medical boards.

A fax is good enough - keep all your copies, and record the times you called, as

well.

I would also send him a certified letter asking for your operative and pathology

reports.

And call your state's medical board and ask them what the requirements are for

giving a

patient copies of these reports. It is probably a state law (in the statutes).

THe statutes

will also have a limit on what they can charge for copies.

I went to one doctor in Atlanta who wanted to charge $85 for a copy of my

medical

records - for one office visit! Of course, they didn't put that in writing, but

wouldn't give

me my records, either. I reported them to the state medical board, which of

course said

that they had to release a copy of the records, and charge no more than the

state allowed.

Brigite, I experienced this " missing " thing when I approached the

hospital where I was implanted. When I was surprised to hear they

were " missing " she said, " Well, we COULD do a more indepth

search...I'll send you this form to fill out.... " Well, who knew????

I tells ya, it really burns me up some of these excuses.

I would be too careful of making him angry until after you have your info in your hands.... I did this with mine - my records turned up "lost".... they were there a few months before as I saw them when I went in to ask the doc to do my explant - then he refused and treated me like crap so I moved on but not before I had a chance to look at my old medical file w/ the nurse there and look at my old pics.... a year later - lost.... I went back offering to pay for my pics (copies) as well as several records.... none were recovered.... I actually wanted them for the MTV taping but he didn't know this... They blew me off the same way - not taking my calls.... not returning messages for days then I just showed up there so they couldn't blow me off.... then I told them what I wanted, sign the release, paid my $$$.... then came back on the designated day.... they were pics of someone else and the wrong pics of me that I had asked for...(he had operated on me 3 times due to complications w/ the implants so he had lots of before and after pics - I wanted the ones from the 3rd surgery - the rupture & replacement) I brought this up then she took out my file... it was two inches thinner than before and half my records were gone and only the pic from the original surgery were there....

just be too careful of angering the office - I know it is illegal for them to lose records but my office did, and if it is detrimental to your explant to have them, you may want to lay low until it is over - then piss him off all you want....

ps - I tried to pursue it and got nowhere - nobody was remotely interested in this guy conveniently losing my records..... sad but true

Oh, I hope you get what you are looking for! It's nice having the help of an attorney, that is for sure. Let us know if you are successful in getting your records. Isn't is amazing how some of these plastic surgeons react? Little kiddies with their egos. I have one more thing on this subject... I brought this up (my case w/ the record thing) to another doctor on Monday just to see and he said - without question, the doctor has to keep your records in his files for 7 years after the last time he sees you... he could have done your implants 20 years ago but if he has done follow up appts, etc or additional surgeries before the 7 years are up - each 7 year period, he has to keep your file for 7 years after the last time he sees you in his office... he can charge you for the copies of course as this is his right but he said under no circumstances can they refuse to send them to you or let you have copies if it is within this period of time - at least in the state of Florida - I am guessing this would be a pretty universal thing as 7 years is the magic # for records in accounting for some things, etc.... In my case it was well within a 7 year period as my surgeon had seen me numerous times for follow ups and had performed 2 additional surgeries on me for complications after the implants were put in. anyways - at least in my state - they would have to give you your record unless it has been over 7 years and then they can legally throw them out...

Now in my case, my original PS did some pretty awful things to me including the record thing... this was not the worst by any means... I may just have to do something now that I know some legalities that he shared w/ me....apparently - this PS has not got a very good "record" & relationship in the medical community w/ other doctors... he wouldn't specify what he meant but he said... "well... he is known for MINIMIZING thing medically and is not very well thought of in the medical community..." I said - oh - like minimizing the side effects of breast implant complications? Lying to his patients?" he laughed and said no comment... I thought this was rather interesting that he said these things as he would be the second doctor that has shared his disliking of this man. hmmmm - I thought they all stuck together but it seems that they all think he is a rat. this was NOT a PS either...
