You forgot to mention what triggered this scheme -- the finding of far fewer drug dependent Medicaid mothers than they had predicted. In other words, they don't believe their own data. They believe their " beliefs, " so to speak, and to hell with the facts. Now their instrument may be flawed, as the article points out, but the way around that is to revise the instrument, not perform an illegal act. Yet they may get away with it, if they administer Medicaid in NYC (unusual scenario, but it may be the case).
