AIDS patients: Detailed govt reply soon …

PATNA: The Patna High Court on Monday directed the state government

to file detailed reply on a counter affidavit to a PIL of Bihar

People's Forum, seeking adequate treatment and care of all the AIDS

patients in the state.

A division bench comprising Chief Justice J N Bhatt and Justice

Shailesh Kumar Sinha issued the directive when petitioner's counsel

Ashok Priyadarshi submitted more than 50,000 HIV/AIDS patients have

been suffering for want of adequate medicare and facilities in the

state.

He submitted the medical colleges and hospitals of the state,

including PMCH, lack facilities for proper treatment of AIDS

patients. In the medical colleges and hospitals and in other

government hospitals, AIDS patients, who lack immunity due to this

disease, are kept with other patients in general wards. Due to this,

there is every likelihood of AIDS patients getting infected with the

disease of other patients, he added.

AIDS affected prisoners: The same bench directed the state government

to ensure proper treatment of AIDS patients in jails and to do proper

check-up of the jail inmates.

The bench issued directive while disposing of the writ petition of

Baijnath Chaudhary who claimed that his son, Shambhu Chaudhary, got

infected with AIDS at Samastipur jail. As Shambhu Chaudhary was

released from jail, the court disposed of the writ petition with a

directive to the state government to ensure proper treatment of AIDS

affected jail inmates.

Petitioner's counsel Yogesh Kumar submitted there is no proper care

and treatment of the AIDS affected jail inmates, particularly the

undertrials belonging to the poor and socially backward class.

He submitted that another undertrial was also victim of unnatural

offence by a prisoner, Sukhdeo Mahto, at Samastipur jail on March 25,

2006, and the matter was reported in newspapers.The additional

advocate general (AAG) submitted that an inquiry had been ordered

into the incident.

Govt asked to complete embankment work: The Patna High Court on

Monday directed the state government to complete the construction of

the eastern part of the embankment of Bhutahi Balan river in

Madhubani district as soon as possible.

A division bench comprising Chief Justice J N Bhatt and Justice

Shailesh Kumar Sinha issued the directive on a PIL of Upendra Yadav

who submitted that the state government had failed to complete the

construction of the eastern part of the Bhutahi Balan embankment.

During monsoon, Bhutahi Balan inundated Madhubani district causing

serious flood problem, the petitioner's counsel submitted.
