I don't work fast enough to handle the volume of work, sometimes I look like i'm in pain or seem grump (but most times i'm happy and friendly) but it brings down the team as they worry, and I've made a few mistakes. I was open with them about RA, and then I got a little OA in there, and have developed some cognitive issues for which I'm seeing a neurologist very soon. My rheumatologist has stepped in to try to get me seen sooner, so we'll see what happens. He prepared an FMLA form for me yesterday, and when I told him what happened, he became very upset about it. He had written me a Drs. note back in February, as my company does not have FMLA. In his note, he explains about RA, what we are doing to put me in remission, and to please have me park close to the building. This portion was never honored. I am now getting a handicap placard temporarily due to the latest incident with my hips. In any case, I will now be collecting unemployment and will have health insurance, but my only worry there is that it all takes a few weeks. I know things seem to take so long when you desperately need them. I am not getting a dime more from my employer as they say I've used all my days, not even a flex fund where I submitted my reciepts for scripts. I never received an official verbal warning, I had a talk with my Supervisor, and I do understand her points, and forced myself to work harder and faster inspite of how much it might hurt. I just rubbed cream on, or took my pain pills. She even noticed and commented on how much better I was doing. If anything, my lawyer said that they can rattle their cage. I also found out that they won't pay my health ins. past April 30th. They are just trying to get rid of you so they will no longer pay for your treatment. I would get some legal action towards them, there were never any problems or issues concerning your work before you were diagnosed, so to me this is a clear case of discrimination. I am tired of people no understanding the pain that we go through and just because we feel better one day does not mean we are cured. Focus on taking care of yourself and do not be afraid to ask for help from family and friends and look into getting assistance for medical treatment. My husband was a teacher and threw a football to one of his students and ended up tearing his rotater cuff. The school discrict refused to renew his contract because was considered " high risk " . He was pretty much black-listed from teaching in the state. Ever since then, he has had a difficult time finding employment. I know it's not from a lack of trying. For me, I was never offered FMLA because I was still considered a " new hire " when I was in the hospital for a few months. (I had already passed my probation peroid). I was fired because I missed more then 33% in my first year of employment. Looking back at it, I had a feeling they were going to fire me when I got sick, but I figured I worked for a hospital and they would understand my situation. I was wrong. When I tried to get on at other hospitals, no one would return my calls. I think I was discriminated against because of my health issues. (My hospital bill was about $450,000; I wonder of I was considered a " risky " hire). I would go on interviews and it would take all the energy that I had for that day and the next. That is when I knew it was time for me to file for SSDI. My friend who has lupus who worked w/ me at the hospital was let go due to her excessive absences. She had been there for years and she wasn't offered FMLA either. She has refused to talk to a lawyer, even though we were basically fired because of our health. I got hurt on the job. tendonitis from repetitive motion injury. I spent about a month bent over boxes using a pneumatic box stapler. AFter many trips to OCC med and therapist it kept coming back. This is when the occ Doc looked at my personal lab results and medical records and discovered what my family doc had missed for two years. RA! When I was so sick due to side effects of MTX and such...I took Short Term disability. It went fine...but when I hurt my ankle they would not play. I had been in and out for over a year. They started sending me home for anything. You can't work in walking boot. Then finally they sent me a nastygram...come back to work and find a new job in the next 90 days or you are fired. But they would sabotage every attempt to find a new job as they would tell that group of managers how useless I was...I was fired. I thought about going after Dell...and what I had to really look at was what did I really want? I knew I no longer wanted to work for a company that had no value on their employees...and saw older employees(30 plus), women of childbearing age and those with disabilities as liabilities. A company that openly practiced ADA, age, race and sex discrimination...So I decided...I would take my money and my unemployment and run. I also had my Long term disability. I used my monetary resources until they ran out....they found some lame reason to terminate my LTD after 3 yrs....At first I thought this was bad...now it was the best thing they ever could have done. I have started my own business and I work in my terms! and I LOVE IT! Decide what you want as the outcome of this....I wanted peace, less stress and freedom. Guest guest Posted May 6, 2008 Report Share Posted May 6, 2008 In 1991, the company I worked for for more than 19 years just laid me off after promises of doing all possible to keep me as long as I can talk and answer the phone. When I finally looked into the ADA, it said emphatically, the company, employing more than 20 workers MUST spend up to $25,000 for each disabled worker, if they want to. There has been some improvement in rules but still have a long way to go. The way I stayed afloat was through unemployment insurance that was extended 2 more times because I was still saying I wanted to work even with my disabilities. Then, I had to cash in my retirement savings, sold a number of old cars I'd collected, and any other manner of buying more meds. Finally, after 2 full years, I finally got SSD. It was still tough until Part D came along. Now I don't have many worries, and hope it stays that way. You should have been on STD or LTD....but they made sure they got rid of you before you go to that point. Its very sad. The blackballing makes me furious!!!! But we all learn from mistakes. If I am ever working in corporate america again and faced with the same problems I will get a lawyer quick to represent me....so they can not screw me over. The Department of Labor is a good idea to try. I know my uncle contacted them when he was hit in his semi by another driver, he was determined not to be at fault in the accident, they still terminated him in case of any lawsuits, and the Dept of Labor told him to call an attorney, but that didn't seem to pan out either.
