Iam a Phlebotomist which is the person that draws your blood for people that dont know what it is.I just cant do it with my hands anymore and I dont want to put myself in a position where I will stick myself.Can my employer fire me? I always thought your job was safe, but am just feeling uneasy about the whole thing.I am afraid.I really dont have much to choose from, job wise.I make good money, but when it comes down to it, I cant work thru the pain anymore.Can I look for something else while I am out on STD, or shouldnt I do that? To annswer your question, I would start the process of getting on SSDI, if you think you can't work anymore. I was fired from my job because I missed to many days due to my RA/fibro. I was working at a hospital and you would think that being in healthcare they would be more understanding. You know your body better then anyone else. If you think you can return to work, then try...even if it is a modified schedule. I would not look for another employer, you may not qualify for their STD due to a " pre-existing " condition. If you miss days during your probation perioid...they can fire you without giving you a reason. If your body is telling you that it's had enough...then start the process for SSDI. It can take a few months (I was approved in 6 months) or it can take a few years. Having STD can give you income while you are waiting for SSDI. It's a hard descion to make. I hated it...but deep down I knew I had to. If you do, just remember that pain is a feeling...it doesn't define who you are. Guest guest Posted June 24, 2008 Report Share Posted June 24, 2008 Giambifan 2001 If you do go apply for Social Security Disability, YOU MUST keep at it and DON " T GIVE UP!!! they will put you thru a lot of paper work. It is best to get a lawyer in the beginning. My daughter got her disability after a short period of time with a lawyer, I'm still waiting cause I got a lawyer after being turned down 2x. Now the lawyer says to wait for the hearing date which takes about 1-1 1/2 years! My mistake was trying to save money and do it myself. The government automatically turn people down until they get a hearing, unless they have a lawyer. I was told about 92% of people are turned down. SO KEEP TRYING AND GET A LAWYER!!! Guest guest Posted June 24, 2008 Report Share Posted June 24, 2008 Heidi Sorry I hit the wrong key. as i was saying the Employer is required to hold your position for 12 weeks due to the Family Medical Leave Act. after that if you do not return they can terminate you. If you go to work somewhere else, your benefits stop. I know it sucks. I thank God bought a long term disability policy and I have now retired from work as a nurse. The LTD company made me also apply for SSDI I did and expect to be denied as that seem to be they way they do it in most cases.I hope you find something more suited to working with RA. The people who review your case are not doctors or even medically trained. they are administative workers. they have specific guide lines. key words and terms they are looking for. If you medical records don't state in specific terms or keys words you will be turned down. I was. then i had to meet with the person who works with appeal cases. she explained how the case workers can not to personal interpretation. so she sent me to a Social security examination dr. and i returned to my own dr and ask the my diagnosis be stated more specificly. once they clarified my problems with a Diagnosis term i was approved immediately. when my brother was DX with MS and RA, i made sure the med records reflected the specific DXs and he was approved with in 2 months of filing. I was also told by the SS appeals case worker that if there is little or no chance of returning to work to make sure i was filing for SDI not SSI. SSI is suplemental income for when you can work some but not enough to support your self. i am only speaking from personal experience but maybe this info will help you. I was head of an authorizations department for a pain management practice, I had to fight tooth and nail with insurance companies. The people who reviewed prior auth for medical nessissity had no medical training. Crap they would review prior auth for specialists and again, they didn't need to have prior medical experience in that speciality. I am not suprised the governement would be any different. In Cali the employer has to give reasonable cause and in some cases like disability a reasonable amount of time. In Arizona where I live now the employer doesn't have to have a reason at all. They can just say go home you don't have a job any more. First, the " nurse " poked me in the belly TWICE and told me that was why I had shortness of breath! Then the doctor had me lay on the narrow table for the exam and then flat-out refused to give me a hand up when I asked! I pray your experience is better. I definitely reported them both to the SS admin. I don't know what the SSA did regarding her employment, but they certainly acknowledged my complaint and apologized promising to look into the situation. I never heard anymore after that. I hope I didn't make your anxiety any worse because I honestly believe this was an isolated incident. I've discussed this with others who have had to go through the same process and they never heard of such a thing either. I think this particular woman was way over the top!
