My attorney told me that if I'm denied (I think it's a given), I should expect an 18 month wait to get before a judge so that would bring me to 2 years also. I'm in New York and plan to compose a letter to my Congresswoman about the issue. If nothing else, it will allow me to let off some steam and maybe she can help. You might give the idea some thought too. I'll be glad to send you a copy of my letter if you send me your e-mail address privately. I don't know what state you reside in, but here in FL, the rule of thumb seems to be to plan on two automatic denials and then a hearing before a SS Admin judge. Waste of taxpayer money and a lot of unnecessary stress for the disabled, IMHO. I have a SS Attorney and we're *still* waiting for a hearing date - Its been over two years since my original application. I applied on my own when I became disabled at 30. They told me I was overeducated because I had just finished college a couple of years before that. The case manager had the nerve to say " you are a cute girl you look good you need to be working " . The ironic thing is I have a severe panic disorder with agoraphobia in addition to the FMS and inflammatory RA and a heart condition and a liver disease. I failed the psych exam due to anxiety and cognitive issues with my illness and the doctor that examined me agreed with my own doctors..I still got denied! I got a lawyer the second time, but fought the system for five years. I finally got presumption of disability which meant there was enough medical evidence to give me it until I appeared before a judge. My lawyer got them to give me back pay all the way back to 2002 when I first applied to 2006. However, I just got my back pay at the very end of last year. My lawyer wouldn't help me with that once we won the case so I contacted my local congressman, he called SSA and got me my back pay in a couple of weeks because my case was such a mess! There should be a law that these cases have to be handled within a specific timeframe or we win by default! I am so furious when I hear these stories about seriously ill people being denied disability benefits! It's insane. I guess they're hoping we WILL die waiting and, unfortunately, many do....there's no excuse for this in our country. Every single person who has doctors statements indicating that they are totally and permanently disabled should be awarded temporary benefits and then go through the process. If in the end they are proven not to be disabled, the benefits should be terminated. I'll bet the government would be moving their @ss pretty quick then! I am in ssi but it took a long time. My son n law was dying, he waited 2 years for disability, He kept getting denied. He had a quadrouple by pass, he weighed 400 pounds, he had congistive heart failure. I am so sorry to say he passed away before he got approved. He was never approved.
