Guest guest
, if you don't mind disclosing this information...what illness was your claim based on and how did you feel that your medical exam influenced the decision? I went for my mandated physical a couple of weeks ago and I got the impression that since I could stand, walk and lift both feet, I would be considered able to work. I am always interested when someone is approved on the first try since such a great percentage of first-time applicants are denied. I got a lawyer 2 months after I filed, I didn't wait to get denied. I got approved on the 1st try. I don't know if it helped me (I was approved in 6 months)...but I don't think it hurt my case. They even approved my onset date, no questions asked. My friend who applied around the same time I did (she has lupus and MS) and frankly she is in worse shape then I am, she got denied and got a lawyer afterwards; her case hearing is a year away. It's hard financially while you are in the process; I had to stay w/ my mother. Guest guest
Dorthy My brother steve applied, he sure could work. but he was a drunk and was apparently nuts. he recieved benefits in 3 months. My sister worked a long time. She had mental problems too. I would say she was bipolar. she got it in 6 months. I applied for benefits. I have many medical problems. Congestive Heart Failure, Narcalepsy, Depression, and Rhewmatoid arthritis. It took me 3 years. Yes it appear as though you cant walk to get benefits. Or you completely mad. LoL. This is really circumstantial evidence. hahaha. I was turned down I think 2 times. Anyway I believe anyones best bet is to get a lawyer. Some lawyers will work free till you get your money. They will take out 25 per cent. A one time thing. Clora From: Dorothy <dorv@...> Subject: RE: [ ] Re: Finding a Lawyer for disability? Guest guest
Actually, the government limits what they can charge - it's 25% and is capped at $5,300. That is out of your back pay & it's paid direct to them so you never pay them at all. I believe if it turns into a lengthy process though, those limits go up. Anyone hiring a lawyer should not put a cent out of their pocket! I heard of a man with brain tumors and after several brain surgeries, he still didn't qualify! I don't get the whole system..makes no sense. _____ From: [mailto: ] On Behalf Of clora ( kloey_1234 ) Sent: Sunday, July 13, 2008 1:56 PM Subject: RE: [ ] Re: Finding a Lawyer for disability? Guest guest
You certainly lucked out! I provided a ton of medical records as well and I know that my rheumatologist and neurologist both filled out the forms they were sent. I don't have a copy of the rheumy's, but the neurologist indicated " Totally and permanently disabled. " I'm not sure if reports were requested from my ophthalmologist or gastroenterologist. But based on the physical, I expect to be denied. You were lucky you weren't called in. You also bring up a very important point that everyone should follow regardless of whether they ever plan to file for disability: ALWAYS get copies of every test results - blood work, MRI's, x-rays, etc. Keep a file with all the copies. It may not seem important to you right now, but one day if you need them, it would be a real pain to try to put together your history. It's very important. Thanks for your response. _____ From: [mailto: ] On Behalf Of Sent: Sunday, July 13, 2008 3:11 PM Subject: [ ] Re: Finding a Lawyer for disability? Dorothy, My main illnesses were my RA and fibromyalgia. I also suffer from PTSD and anxiety from a tramatic hospitization and mild bi-polar. I gave SSA all of my medical records from the past two years, including the hospitiazation. (I get copies of everything from every doctor I see). I took that personally to my local SSA office. (It was ALOT). I stated that my RA and fibro were manageable until the sepsis. After that point, my RA/fibro went into " overdrive " and I could no longer work. I provided pictures of my joints from before the sepsis and after. Yes, I am weird for taking pictures of my joints...but I keep detailed medical history for myself on my own. When I did the filled out the paperwork, I was very specific on how my RA/fibro affected my daily activites. I told of my treating doctors that I am applying for SSDI. They filled out their paperwork. I didn't see an SSA appointed doctor for a medical exam, but I did have to see a psychologist. I can't tell you why I got approved so quickly, but only what I did. Maybe it was because SSA didn't have to wait for my medical records, maybe it was because I was very through with my description on why. I did get a lawyer from the start. He didn't wait for me to get denied, he put in a motion for a hearing when I retained him. He said let him know when I get denied. I didn't. They approved me and they approved my onset date, so he canceled my hearing. Maybe it was because I did get a lawyer and SSA didn't want to bother fighting my claim because I had representation from the beginning. I don't know. I am 31, I thought they would deny me based on my age alone. All I know is that I did something right and I can tell you what I did. > > > > Hi, > > I recently posted my sitaution. Guest guest
Yes Save all your medical records, You will need them someday if not for SSD but for other doctors. I had to give information on all the jobs I had for social security. I had so many jobes it wasnt funny, as I said before I have suffered an unknown pain my entire adult life so it was hard for me to keep a job. I had to have the date of my last day worked. At the time I couldnt remember. I remember now. It was when 9-11, when the buildings in New York came down. I heard it at work and came home and cried for 3 days. and never went back to work. that wasnt the reason. I am very ill. It dont matter how sad you look. My lawyer wanted me to look pitiful. He even told me not to dress up real fine for the hearing. He said for me not to drive to it. This is crazy. I difinately was disabled. My aunts sister told the doctor who examined her for social security that the hated him lol. And he didnt do anything to be told that. She got it within 6 months. And my son n law was dieing and he got turned down. I think right now the SSD adminstration does what ever the heck they feel like doing. I would never work for them because if someone is unable to work I would have to pass them. Please get you a lawyer. If the one you call says wait till you been turned down, keep calling lawyers till you get one to take your case, If you can't afford one, there is plenty out there that will do it for free till you get your settlement. Guest guest
Mina I tried to get a lawyer. If you don't have money up front the fires lawyer wanted me to wait till I got turned down. I did that, so I called a lawyer I found in the telephone book. He said never wait I would have accepted you when you first signed up. Anyone who is signing up for disability better get a lawyer. Social Security tries to trick you into saying the wrong things, I am the type of person who would say all the wrong things. and i am severely disabled. I can only walk a few feet before I am out of breath and in pain. A lawyer will tell you all the do's and dont's. And there is a lot.
