Guest guest Posted September 24, 2008 Report Share Posted September 24, 2008 Hello, I was wondering can I apply for SSDI WHILE I am still working, or do I have to be unemployed? I am so confused.I just started a new job after being on short term disability from my other job, but I am in pain every day and in between meds due to complications.Should I get a free consult from a lawyer that deals with this? I filed for SSA, when I couldn't work any longer. It took one year, and I'm so glad. There is NO WAY I could hold a job down. Someone will help you here, we have an amazing group. Guest guest Posted September 24, 2008 Report Share Posted September 24, 2008 Heidi, I went in to file while I was still working and they let me do the initial application so it would start the clock and then denied it because I was working. So, a couple of months later when I lost my job Because I had been out so much I went back and they re-filed. They almost immediately denied it again, but a couple of months later, they reviewed my file and found 100% favorable in my favor. One thing my attorney had me doing was keeping a pain calendar with a scale of 1 - 10 for my pain. I also noted other things like muscle spasms, swelling etc. I also wrote to my state Senators and Representatives and asked them to look into the system and why it takes so long. I don't know if that helped or not, but they did approve me after only 5 months. Guest guest Posted September 24, 2008 Report Share Posted September 24, 2008 Heidi,I belong to another online support group on that is for people who have questions about the ssdi process and what you have to do to qualify and how to do that.I had to be terminated from my job and also find a Doctor who would support my claim that I was unable to work which was difficult for someone with fibro,its hard to find a doctor who is willing to go out on a limb and say you cant work.I had to go to a neuropsychologist that would support my ssdi claim on grounds that my depression and my physical problems were causing me to be unable to work,then my pain doc/neurologist got on board.I suggest you go and speak with your doctors first and also find out about your employers disability insurance if you have any to find out what they would require too so that you can give your doctor the forms for them and get FMLA leave from your job and give the doctor those forms also in person at your next visit and then take a leave of absence from your job,as long as they will allow you to.Here is the link to the disability issues group on that has helped me with my ssdi case a great deal.I suggest you join this group and ask your questions to that group as well. SSDI requires that you are unable to earn 940.00 a month due to your medical condition and that the condition is expected to last for more than 12 months. My experience is that doctors do not encourage you to file but perhaps support you once you have made that decision. Most lawyers will not look at your case until you have initially filed and have been turned down once. The group helped me a lot to make the decision to file, but ultimately only you can make that decision based on your own medical condition. Personally, I'd rather work towards have as many pain free normal days as I can. Hope this helps.
