I can tell you from experience that what your manager is doing is legal. I

worked for s Nursery and Crafts. I got hurt and when I couldn't return

after 12 months, they legally fired me. Didn't matter that I might have been

able to return soon, I was gone. It was a hard blow to take, as I had worked

myself up from a seasonal cashier to Assistant Manager in two years. I use to

work 60 to 65 hours a week. I was salaried so they didn't care how many hours I

work.

I hope this is horrible news but your company can do what they are doing. You

probably need to get a copy of their short term policy. If you have a hand book

what your manager is telling you, is probably in the book. If you don't have a

handbook or a copy of their disibility policies, ask for them.

This CAN be done legally. Check your employee handbook for their policy on

short term and long term disability.

Have you talked to the store manager? What about human resources at the main

level of your company?

Honestly, that is what I would do. Talk to someone who knows the laws

and can be there to defend you. Best of luck to you.

I live in NY and NY has what's called " employment at will " and that means

that you can be let go at any time for no reason. It also says that you can

quit at any time for no reason - I've never figured that part out. Of

course, it doesn't apply if you have a contract or are part of a union with

one.
