I am currently in the process of getting my Long term disability approved, and I have been receiving letters from my Store Manager not the company stating that if I do not return to work in five days I will resign my position with the company. Does this sound right, or does it sound like harassment? I have been receiving a paycheck from short term disability for the past six months. I am currently talking to a lawyer any opinions? Guest guest Posted July 16, 2008 Report Share Posted July 16, 2008 Yes, this is legal. Once you have used up your 12 weeks of FMLA you no longer have any job protection. So they can terminate you and will based on their own rules. I too have been a victim of the same thing as a former Dell employee. To make it works my ex-employer refused to even allow me to train in a different position that I could do with my limitations. I would cut my loses run and find a new position. If you can qualify for long term disability benefits as a continuation of your STD I would see that route. However be prepared for a constant fight. I would look at the these two that specialize in advising those with disabilities. Dininissues Off topic place.
