Rick. I read this over and it seems to be a proposed rule. And a

good one at that. We then asked our local Medicare person and she

told us it was not yet final. Tell me it isn't so!

Pierre,

It is final, but CMS is accepting comments on the

final rule. Here is the link to the final rule. If you

read the first page, it will give you the effective

date of most of the final rule with 2 sections being

final on July 1, 2008 and another section being final

on January 1, 2009.

Hello Everyone!

Concerning the 90 day certification/re-certification rule.......

I have contacted our CMS contractor (Noridian who covers 13 states including

Montana, ND, SD, AZ, CO, etc.). I have been informed by their MC Part B dept

that the 90 day rule has not been implemented and is still proposed. They

(Noridian) are still operating under the 30 day POC certification /

recertification rule).

The manager of this list serve denied a posting by myself last week in regards

to this rule and stated that the 90 day recert rule was implemented as of

1/1/08. I welcome any direction here as to where this is stated by CMS so I can

point this out to Noridian and save us all some headaches. We, at our practice,

are continuing to operate under the 30 day rule until Noridian is updated.

Chad,

Our facility has encountered the same response from our CMS contractor here in

IL, that the 90 day recert is proposed, and only for CORF's, and they are

operating under the 30 day rule for recertification. I have provided our

Director of Patient Financial Services with copies of the pages from the

transmittal for when she speaks with our contractor again.

The 90 day certification period is for all outpatient

settings. It is not proposed. It is final and not

proposed. CMS has not issued the Change Request yet

notifying the contractors of the change. This will be

out soon and will be retro to January 1, 2008. Read

page 112-113 and page 185 of the November 27, 2007

Federal Register.
