Dear FORUM,

HIV+ mom can’t take care of child: It is a Human Rights Violation committed by

the court.

The Dismissal of a petition filed by a Mother living with HIV+

by the local court of Rajasthan on Sep.20 to Hand over her Daughter

to her, is purely a Human Rights Violation committed by the court.

Under the law, That the mother has HIV+ is not a valid ground for

seperating the mother and the Daughter.

Even if the mother can't pay the child's expenses, she can keep the

child.

It is also not mentioned in the article about the age of the

Daughter, and whether she has the capacity to decide

her stay with whom.

Already the Pettion was filed against the Domestic Violence committed

by the In- laws, the decision of the court again supporting and

encouraging the activities of the Accused.

Though the local court and its Judges are not a final place to decide

ones life. we should take this Judgement as the Individual openion of

the concerned Judge, and should appeal the case directly to the

supreame court.

Organizations working for PLWHA in protecting their Rights should

raise their voice against this Judgement and should provide

solidarity to the Mother living with HIV+.

Create a National Level Discussion on this issue, so that some new

things good to the PLWHA can Happen in National level.

The Courts Teaches Law to the Nation, What to do, sometimes we the

people of India Has the duty to teach Law to the Court. Thanks.
