Guest guest Posted June 18, 2002 Report Share Posted June 18, 2002 I work for a transfer/911 service and we take patients like that frequently. the hospital can discharge the pt to the ambulance crew and to the other hospital for the appt. then the crew can transfer the pt back as long as you have not left the pt. that is the way we do it here. as far as i know it is all legal. If this patient is discharged from the hospital then I would not think their is an issue with this arrangement. Lee EMTALA Question I have a hypothetical question for all you EMTALA gurus out there. Guest guest Posted June 19, 2002 Report Share Posted June 19, 2002 Anytime you are dealing with any hospital to hospital transfer it is a COBRA issue. I am the director of a hospital based EMS. We have contacted CMS on more than one occassion to get an opinion. My advice to you, do the same. Get it in writing who, when and what was discussed. Documentation will be of the upmost importance if an EMTALA investigation comes. was our contact person in the Dallas office but I believe he has been reassigned.
