Guest guest
EXCUSE ME?!?!!? They keep a kid from having LUNCH?!?!!? NO WAY!! I'd be raising holy hell with that one. I wouldn't care what their " rules " are or whatever. No kid of mine is going without lunch, unless HE decides he doesn't want to eat. I don't care what the infraction is. Hope you feel better soon, and really rip someone a new hole. You don't know how angry I am for you. That's almost as bad as corporal punishment. ellen cancelled IEP I THOUGHT I had called to cancel Boone's IEP, but apparently they went ahead and had one without me rather than postponing the damned thing. I have a nasty case of strep throat. Where do I begin? With the excuse for an IEP which is ripped into small shreds at this moment and will be signed over my dead body? Or with the report that was sent home stating " Boone was not allowed to go to lunch again today because he didn't finish his work ... " NO LUNCH?? AGAIN? WHAT THE F***??? The fact that today is Saturday and everybody at the school was gone when I got the report yesterday has also added to the responsible person's life span and possibly saved me from a life of imprisonment. No wonder the poor kid has regressed. I've made a decison. I'm not sending him back to school until everything is resolved. They will hear from me and my lawyer. Guest guest
Sissi ~ I am asking you this in an attempt to save your sanity, and keep you from killing anyone. Is homeschooling an option for you? At this point, I would really be considering it as an option. You know, I would be ready to kill someone myself. Personally, I would be going down to the school, breathing on everyone and giving them strep throat. They deserve it, and a whole lot worse. I just had a fit on my son's school and told them food is NEVER to be an issue unless he's throwing it across the room or smearing it somewhere other than his plate. One of the lunchroom VOLUNTEERS took another LD kid's sandwich and threw it in the trash because he ate his chocolate first. EXCUSE ME??? I ever find out she's done something like that to my kids and I'll put her in the trash. How dare they withhold Boone's food?????? Are they being petty because of the milk issue? Guest guest
Legal field day with this one Sissi. I totally agree with keeping him home until this is resolved. Withholding food is a form of corporal punishment and is abusive. They also cannot hold the IEP meeting without you even if you hadn't called to cancel unless they have made repeated attempts to have one with you and have not had any response at all. Go sic your lawyer on them!!! And you take your meds and a nap. Feel better soon. (((hugs)))

Guest guest
Another thing about yesterday. Boone went to sleep as soon as he got home yfrom school. He slept until suppertime. After he ate, he immediately went back to sleep. He slept all night until 8 a.m this morning. This is soooo not like Boone, but he could be sick too, I just don't know. He's not acting very sick today. I was really worried. I mean really, really worried. He seems fine now and I don't know what to make of it. Guest guest
> Hmmm.... > Wonder how much legal trouble the school can get in for this... > > Georga Unfortunately they won't.... Because they documented ( by sending her a note home )saying he didn't not follow a direction ( finishing the work) and the consequence ( not going to lunch till it is done)was given, and the direction was not followed, they unfortunatley are within their legal rights to follow through with this consquence. To ensure this can never happen again or there WILL be legal recourse if it does, Sissi must document to the team that this is unacceptable, that him missing lunch or going to lunch late can NEVER be a consquence. Without this documentation there is nothing that can be done execpt complaining. Sorry to be the messenger of such unfortunate news. Guest guest
I have NEVER heard of a school not letting a kid eat because of this or that. Not going out to recess on the other hand is used a lot. I think that there should be some legal recourse here. Think about it. If you or I decided to send a child to bed without dinner for something and the neighbor found out they could call child protective services and there would be an investigation into abuse/neglect for not feeding the child. How come that rule applies for us and not schools? Serious here. Where there may not be a " law " about it, I think that taking it to court (yes, pain in the ass thing here) on a charge of abuse by the teacher would cause a lot of problems for the school, the teacher, and the district/county. This could also be approached as a discrimination thing. I mean, the school has documentation that Boone is autistic. Being autistic there have to be allowances made, these kids can't be expected to be like the NT kids, and behave exactally like them (this is why there are IEPs, this is why Tony Attwood is advoacting either no homework or homeschooling for children with Aspergers Syndrome). This can be seen as discrimination. So he didn't finish his work. The child either stays after school to do it, gets sent home with it and the parent has to sign that it was done, or the child does not go out for recess. Not feeding a child, that under IDEA, is handicapped because of a disablity that prevents him from doing something, is ABUSE. This is something that I seriously think can be fought. The problem is, *MOST* parents don't want the hassle of fighting the school, questioning the teachers, etc. They want very little involvement in the education process. Guest guest
I don't know if it's legal or not, but I know this -- IT'S WRONG! I have a " modified discipline plan " for Boone which is part of his IEP. This is the second violation of the IEP (that I am aware of). I just can't let them do this to him anymore. They're turning him into the most miserable kid I've ever known. Now they're complaining about hius behavior. I get a page full of complaints about his behavior every school day. They have consistently denied he is a behavior problem. Now he's suddenly a behavior problem. They can't have it both ways. They can't continue to deny behavioral therapy and while saying his behavior is a problem. I'm going to sue. Even if I have to get a second mortgage on the house, I have no choice at this point. I guess I could move to another state. But you know, that's not really realistic. Guest guest
-- I have never heard of being denied lunch as a punishment for not completing work. I mean its not even a behavioral issue necessarily. If a kid a school doesnt do the work, the usual protocal, not to give a good grade or reward or whatever. I can also see no recess being used as well( which im not so keen on either, since young children-disabled or not need to get a break for their health). The first or second time a kid doesnt do the work, they should inform the parent that there seems to be a problem. You may be punishing a kid when something out of their control is happening. The kid could be tired or sick or whatever. To put it simply, it sounds like a bad teacher. Furthermore it could be a bad school. It just seems like these things become a vicious cycle, how do they expect a kid to work in a setting where theyre basic needs are not being met. Id say theres a lawsuit here. Not having a parent informed/participate in an IEP meeting is definitely illegal. Guest guest
Just for the record, everything that I have found so far states, by law, that withholding of food is neglect and can be considered cruel and unusual punishment.
