What I was told when a payment was flagged that the mortgage department had the account in foreclosure. The bank and accept payments and still proceed on foreclosure or they can refuse payments once foreclosure proceeding have started. the only option is to catch up with the back payments or pay off the mortgage. You can get a lawyer who can help you file bankruptcy. That will not guarantee saving the house. It if want to save the house during bankruptcy you have to bring your payments current. I have been through foreclosure and I warn you that it is very difficult when you fall behind. Chase bank is one of the worse for getting them to work with you. We applied to Fanny Mae program (this was 15 yrs ago) and nothing came of it. Don't give up looking for something to help! Do you have family that could lend you money so you could get current. I know the bank will not accept smaller payments, but they will possibly accept the delinquent amount. If the worse comes and you can borrow money from family but not enough to catch up and stop foreclosure, you could try and get the house back when it goes up for auction. The bank will try and sell it for what is left on the mortgage principle. Another idea is if you have some equality in the house try and sell it to one of those companies that do quick sales. You may be able to pay off the mortgage and have some money left for a down payment on a less expensive house. I understand the stress you are going through. It was one of the worst experience I have gone through.
