Also, you may want to consider throwing in a slight premium for the additional stresses and strains relating to being in the witness stand. One side benefit is that unlike when you bill insurance, your one on one time in the witness stand usually does not get reduced to usual, reasonable and customary. I did a great deal of research prior to setting my rates. The going rate for a PT is $200/hr for research, document review, summation, and consultation time. If the case goes to court, I charge $300/hr for depositions, court appearances and testimony. You should charge in increments of 6 minutes--the same as attorneys charge. You will be asked for your rates under oath and you will need to be able to justify your charges. These cases can be very stressful and you have to keep in mind that when you are involved in a case, you cannot get anything else done. Also, you are going to be paid as a W-9 contract laborer, so you will be responsible for all taxes and both sides of your social security contribution. I would not even consider being involved in a case for less than $200 per hour. In addition, I usually ask for a " retainer " up-front to cover 3-6 hours. Every attorney you deal with will consider this to be perfectly normal, and they will happily pay you for your time. Lastly, I am very up-front with the attorney and I tell them that I will be giving my honest opinion and I will not be persuaded by who is paying the bill.
