Guest guest Posted September 16, 2011 Report Share Posted September 16, 2011 Record retention can be pretty complex. One needs to identify if any of the following pertain to your documents: 1. Mandatory Requirements - i.e. statutes or regulations (for example, there is a statutory requirement that x-rays be kept a minimum of 5 yrs) 2. Statute of Limitations (often 7 years although longer for peds cases): This is not legally mandated but it is pretty easy to predict that certain types of documents could be relevant to a lawsuit. 3. Safe Harbor Statues/laws-I believe these tend to be State rather than Federal. Having said that, we keep our financial documents related to patient billing for 7 years based on the Statute of Limitations, even though our medical records are kept for 30 years because of the pediatric population.
