" You have a patient who requests your professional service, and you are competent to perform the evaluation. If you are in a state which permits PT evaluation without referral, just make arrangements for payment and do it. They called me today and stated they will not refer out their own hospital system. I called the patient and asked him to call the doctor and discuss free choice of providers and that he really wanted me to do the eval. He called the physician, but the physician is adamant that she will not refer outside her own hospital system for PT, and that she will be glad to give him a prescription for PT within the system. The patient is wanting to pursue reporting this illegal behavior. How does he go about doing this. Anything I should be doing about this. I have always known about physicians doing this, just never heard of anybody doing this when the patient is requesting a specific PT and never heard a doctors office just coming out and blatantly stating that they are doing this. Is there a reason why you couldn't do this? This physician doesn't sound like one that would refer to your clinic anyway so there shouldn't be a concern about losing a referral source. Unless the patient's insurance is dictating the physician, the best way to send a message is for the patient to fire the physician, establish with a better physician, then tell all her friends and family to follow her there. This is just business and there is nothing unethical to you recommending this to the patient as long. First, though, we need to know is there is a reason that the patient could not do this. Guest guest Posted January 6, 2012 Report Share Posted January 6, 2012 There is no reason why the patient couldn't do this, other than this is a primary care physician and around here you are lucky to get in with a primary care physician in 3 months. We do not have enough PCP's in this area. While getting another physician would solve this patients problem it would not solve the problem of federal law being broken by not allowing patients a choice of provider in general. I am not aware of any stipulation that I therapist cannot see a patient if the prescription for physical therapy is not on a specific type of prescription script pad. If the physician is willing to write a prescription, then have her do it. The patient can then take the prescription to any provider he would like. Someone please correct me if this is not correct. We see patients frequently that have prescriptions written on other facilities script pads. If not and you have authorization to treat, you're set. The doc doesn't have to like it. The patient chose you and insurance approved it. End of story. Guest guest Posted January 7, 2012 Report Share Posted January 7, 2012 Great thread and some really good thoughts and opinions though I see that you still haven't had your question answered so, because I would like to know the answer as well, I will re-ask it: The patient is wanting to pursue reporting this illegal action, how does he go about it? I have run across similar actions and I have called the physician directly and asked them to explain to me why they would deny a patient their right to see me, I ask if there is something I or my company has ever done to or with one of their patient's in the past that has concerned them, when the answer is no I then again ask why they would deny their patients rights. I explain my relationship with the patient, why they have chosen to see me, etc. I have never had a refusal beyond that point though I have had a few who refuse to ever come to the phone, for those we find another physician or I ask the patient to go to a local walk in clinic for a referral, the shame of that is the increased cost not only to the patient but to the entire system, something we and the APTA should be shouting from the mountain tops. (Am I wrong?) If this is the case, doesn't it seem important to address the issue rather than skirting around it and finding another physician outside the hospital to make the referral? If this is illegal behavior, shouldn't there be a method for correcting it and facilitating a change of the hospital's policies? Guest guest Posted January 8, 2012 Report Share Posted January 8, 2012 I would be surprised if that is the position of a single physician and not a general policy (to only refer internally) that is propagated throughout that hospital's entire system. (Am I wrong?) If this is the case, doesn't it seem important to address the issue rather than skirting around it and finding another physician outside the hospital to make the referral? If this is illegal behavior, shouldn't there be a method for correcting it and facilitating a change of the hospital's policies?
