Hi Steve,

We had problems with a debt collection not paying and not pursuing claims so

we hired another debt collector who was able to negotiate taking over the

cases from the other agency. Depending on any laws preventing this, this

might be a route to take. The new agency can review the case in question

and pursue your payment.

Even if you lose on this case, you may make up the loss through better

management of any other open claims or if the new agency and you work out a

better contract with a lower percentage that they earn from each case.

Bottom line is that this is business. You have a subcontractor that is not

performing their job. Get rid of them and move on to a better more

competent debt collector and, if possible, let them take care of outstanding

accounts. Make sure that you work out an appropriate contract, which is the

only place I would recommend getting a lawyer involved in.

Debt Collection Agency or Lawyer. which is the best place to start?

I hate to look at this but have a client in another state who slow paid half

his invoice then stopped paying. Amount is too large for small claims court.

I suspect I cannot recover the court/collection costs since we did not have

a contract that specified this would be covered. What kinds of things

should I look for in an agency and do I look for a local in his state (NC)

or national firm.

I had done occasional business with the customer for 2 years and he always

paid on time. I am past making a profit and just trying to recover my

direct costs. This is obviously something that I find deeply upsetting to

consider; but, I need to look at it and want to limit my expenses.
