Well I have the letters from my doctor stating when and what kind of diet I was on for a year. Did you mail yours to the insurance company or just gave it to Dr. Rutledge and let him handle it. I was taken care of by (she works for one of the other surgeons and was helping him until he hired ) she faxed it to the person reviewing my case and it was approved imediately! Go for it- I would drop it to ASAP- and she can handle it for you- with Dr. R all ready credientialed- you shouldn't ahve any wait ata ll!! Good luck and keep me posted! I thought it was going to be a big problem to get them to approve me so I just set my mind to call, fax and email them everyday. You are right about the " busy work " . I have already been trying to gather information. Janet S. suggested that I try to find a case where maybe they had approved this type surgery, I just have to figure out where to start on that one. As of tomorrow, I am going to start trying to document my diet history and trying to find documentation of it. Any suggestions? What about you? Did your policy have an exclusion? Literally, the only surgery which the quoted language excludes is " surgery for cosmetic reasons. " If your surgery is not " for cosmetic reasons, " the exclusion does not apply. The gobbledigook refererence to weight loss surgery applies only to " surgery for cosmetic reasons. " Under an important principle of contract law, ambiguous language in a contract is construed against the party that drafted it. This rule is applied to insurance contracts frequently, because the even though the insured person is a party to the contract (or a third party bneficiary of the contract), he/she could not participate in drafting the policy language - you must take it or leave it. These are called " adhesion contracts. " A decent lawyer should be able to take the exclusion (if that is the basis for denial of coverage) and stick it into the insurance company where the sun don't shine. Good Luck! Dave from Michigan. I am in ND and did not really realize how close the BCBS coverage was from state to state. We had insurance through Cobra from a BCBS spin off, and they denied me outright, and then denied my appeal. Even though in my handbook it said that medically necessary procedures would be covered, I was told that policy had changed. SO, I switched insurances! It is not as difficult as it might seem. I did some research and found out which companies were most likely to approve and I set up interviews with these companies. My hubby owns his own business and I work for him. We only have 1 other employ, but yet we were allowed to obtain a policy without dealing with the preexisting conditions or insurance physicals. The only thing we had to deal with was what our premium was going to be. We ran into a little bit of trouble here because of my thyroid and diabetes, but my hubby was able to talk them down. As soon as it went into effect, I was at the surgeons office - and now, less than a month later, I am going in for surgery. I realize that laws might be different in different states - but if you can possibly set up any type of home business - this might be your best bet at getting approved. If anyone has any questions, I would be glad to answer them - as soon as I return from my surgery. I am so sorry that you guys have been denied. I know how heartbreaking it can be to get denial after denial - just don't give up. All I have is my son's " light saber " but the batteries are low! Everyone has been so great! Thanks for the support! Ya'll make me feel so much better about everything. It gives me the strength and motivation to FIGHT! And if I have to, I will fight! I am going to try to see if I can find out if anyone has ever been approved (that has my policy). Guest guest Posted June 3, 1999 Report Share Posted June 3, 1999 , OK here is the armory I currently have one small cat WITH claws (sneaky huh?) one case of hard headedness when I want something one Sams Club mega pack of Light Saber specific bateries one case of bad music appreciation (crappy 80's music my friend says) -in reference to above see Swayze(ME) in Ghost trying to get Whoopi Goldberg(BCBS of ND) to help him one case of nothing better to do than work on an appeal all summer if necessary one stick of glue stick to get BCBS to sit still long enough to hear my appeal!
