I've been told that many lawyers work on the plan of not being paid unless you are successful, but you would need to establish that at the beginning. And you'd need a lawyer who knows the SS routine (ropes). You also need to get your doctors to write stronger letters and have strong documentation. I haven't been through this, but I've read other people's stories and experiences. Sorry you are having to fight over this. More stress. Because of so much fraud they are more strict than they were not long ago, but people still do manage to get accepted when they have legitmate claims, like you do. Good luck, and keep in touch. Also, double check with your doctors as to what they have written in your medical files. If you are unable to work, your doctor or doctors needs to have that documented somewhere. I was turned down also, and I have 3 clogged arteries, plus CMT. The doctor that examined me at SS also said I have curvature of the spine also, and him was also the one to diagnose me with CMT 20 yrs earlier. He tried to tell me I was to young to retired and get disability, I'm 47. I told him that I could have filed for SSD 20 years ago and I didn't, and now I need it. I also got a lawyer to submit my 2nd request. I finally got SSD, but it is only for 2 years and then my case is up for review. Also be aware that a lawyer can charge up to 25% of your initial lump sum payment of SSD. I got approx. $7,800 for my back payments of SSD and had to pay the lawyer $1,771, and I never even had a face to face with the lawyer. Everything was done over the phone. (whose specialty is post-polio syndrome - he is a physiatrist) that most people are turned down the 1st time. He suggests securing an attorney who does at least 50% of his/her practice in SS disability. I have a friend whose daughter has fibromyalgia plus other complications and this is what happened to her. She is now on disability. Guest guest Posted September 3, 2000 Report Share Posted September 3, 2000 Jim..... also, my dr. recommended I start keeping an almost-daily journal of my physical condition - record everything i.e. falls, numbness, fatigue, pain and any progression. Hopefully his documentation and mine will make the process go smoother for me when I apply. I know one CMT individual who hasn't seen a neurologist in many years. All she has seen is a primary care physician. She never complains about her aches, pains and difficulties, so there's not much documentation in her physician's chart. This is an important component for the SS process. I wish you the best as you go thru this.
