The contract I signed listed circumstances where a wean would be provided and

situations that abrupt cessation would happen.  Early refills etc, lost

prescriptions get you a thirty day wean, blood tests that come up different then

expected is abrupt cessation.

Recently i  read the DEA laws.  It is a violation of law for a dr to knowingly

prescribe controlled drugs to a patient who is breaking the law diverting drugs.

I was even more shocked when it also said if the doc knows there is active

addiction, which makes no sense to me, as they don't define addiction.

I will look for the link.  It basically said that at the point that

a physician knows that a patient is abusing/selling/diverting their

narcotic they are committing a crime if they write another prescription.

The website is DEA office of diversion but i haven't found the exact page.

sorry, I spent an hour looking.

I guess the most important thing is for one to keep a copy of the contract they

sign.  When doctors give referrals when they have abruptly ended the doctor

patient relationship they do that so that they have not 'abandoned " the

patient. A patient who has been fired from a doctor (if not done in person)

needs to be done by certified mail listing some alternative dr's names.

I looked up the pain patients bill of rights, the laws in my state in regards to

prescribing etc.  The reason docs do drug testing on their patients is to

protect the doctors license and to prove that the patient is taking the drug and

not diverting the narcotics.

If/When a patient has a urine screen that is negative the doc has to assume

diversion.  A person with a drug screen that reveals no opiates, why may I ask

would they require a new script so that they can wean off?  They have no drug in

their system, therefore an additional  script in the eyes of the physician would

mean more drugs diverted.

Deb,

No, that is not really correct, pain laws and contracts state they MUST provide

you with so much medication and a doctor listing so even though you are

Suspended the doctor is supposed to provide these. My pain contract states

thirty days.
