This is What I would do and I'm NOT trying to impose on you and I'm not sure of the Details really. About loosing your Home, I would Quit paying anything but The house payment and Utilities and Food in Anticipation of Filing Bankruptcy. Call the Mortgage Co. if you are behind and make Payment arrangements about the past due, Explain about you Disability and that you'll Catch up in So in So months (by using the money from the other Bills you don't pay) I have had CFIDS/FM for 10 years and I had to make that Choice in 1997. You can EXEMPT the house from your Bankruptcy and save your home.You'll have months to worry about actually Filing so don't worry about it right away. (I hope if you're on a Fixed Income, you get the Discount on Utility Bills that is Available) Now as far as the Children, I take it, if I'm understanding this right, the Court Action is because of Absenteeism?? 1. Gather all Records from the Doctors and If possible a letter about their Inability to attend School on a Daily Basis. 2. Try and Reconstruct ALL dates and Conversations you've had with the School. (type out for easy reading) 3. Gather All Report Cards and other papers Showing their Positive Progress along with any Written Documents the School has Sent you. They Should have been informing you of any Action IN WRITING as the situation progressed, if Not you can let the Judge know just how Shocked you where. 4. I would mention you're disabled but NOT empathize it too much because they could find YOU incapable of Raising the Children. (I have been thru the Court System 4 years ago with my now 7 yr. old Nephew (now my Son), Termination of Parental rights, etc., and I had to get a Letter from my Doctor saying I could Raise him even WITH my Disability (another long story). 5. Let the Judge know you want the School to do a IEP to Evaluate the NEEDS of the Child because of their Disabilities 6. You might what to Consider HOME SCHOOLING, it's not something I could do with my Son, he's severing ADHD and with my Illness well, He needs to be in School.
