I was approved, but I did have to have an exam by one of their docs...but they did get all my doc records from my doc. Their doc took xrays of my hands and feet and looked at my hands and feet, thats all. My lawyer (I'm in TX) told me that if I was in OKC or Austin, I would not have been denied. But because mine went through Ft. Worth, I was immediately denied and I have many diseases, not just RA. First application is automatically denied if the illness is not fatal in the near future. In the second application, the file is actually opened and read. Normally, they depend on folks getting tired of waiting and go back to work. The third step was the judicial review. That was attended by a traveling federal judge and his assistant. Along with the files, statements from doctors, family members, and the victim were taken. The decision was to be made " in about a month " . After that, you started over again. I never got a lawyer because I didn't feel like giving money to someone that didn't really work on the case or suffer like I had to. I was lucky to have immediately got my decision from the judge. He said he didn't understand why I was ever denied. I didn't either, maybe it was just politics. When my mother applied, it was for SSI because she never worked outside the home, so she didn't have anything paid in to Social Security. All her finger joints were solid, as were much of the rest of her body, but they wanted her to work as a cashier at a gas station. She couldn't even open her medicine bottles! HOWEVER - In light of your post, I will express my opinions about your post to the group and NOT my representative. I have no way of knowing if the information you have just posted is accurate or a fabrication. Some people may take this information as gospel truth and have it follow them to the voting booth. It would have been helpful to include your sources, including publication names and dates.I would HATE for this forum to become a political battle ground. There ARE other disability advocacy groups out there that publish credible statistics - why not post a link to them instead of airing it out here?Moderators - please for the sake of all you are advocating for and for all the hard work you have done - you must make a policy decision on issues like this before they get horribly out of hand! I'm just now learning about the difference. SS(D)I is for people with little/no income, so the recognized poverty level in your area is the basis for their decision. It also has to do with points you made by working in previous jobs. You need a specific number of points, made in the last 10 years, in order to get Social Security. For instance, it takes 20 for me, and I have 12. So I actually need to find a way to work and make those last 8 points before I reach the age of 50 in order to be applicable for Social Security. I've also put together a letter for my PM to sign off on. I've talked to several people that have had a good experience with detailed documentation from their doc. I filled the form out with a lot of things that SS would be interested in--how long I can sit walk climb stairs, etc... and the only part I left open was a place for the PM to put in a diagnosis and prognosis. It's about 3 pages and from the info that I've gathered it holds a lot of weight with SS--more than tests, etc.. So I have my fingers crossed--frustrated but not giving up---yet. I had a lawyer and won after 2.5 -3 years. The most important thing I was told was to have as much documentation as possible. Also the documentation must be dated since you've applied for SSDI and stopped working. If you are working in any way, you can't get it, unless it's under the table. You need the Doctor to put in writing that it is his opinion that you are in chronic pain that will not allow you to work, and there are no forseeable changes in your future. It also halps to have this from more than one Doctor. A pain management specialist, your surgeon if you had surgery, your primary care doctor, a Therapist or phsycologist if depression is part of your problem etc. I was Blessed in that my wife beleived in me and she was the sole breadwinner. She also had good enough insurance that I was able to get all new test and doctor visits. It was very frustrating I had a Bankers Box full of medical info, 5 years of it, but it was all pre my stopping working, so to Social Security it may as well never existed. If your not Lazy and you push through the pain to stay aflote until you can recieve help, you'll never get it !!! They make it very hard to survive until you can get help. If you work through agony, well then you can work and don't deserve SSDI. I had a three ring binder full of fresh medical info, but what won my case, was my surgeon admiting on paper that my last surgery DID NOT Help me. and in fact put me in more pain. It was that or I start talking to his waiting room full of potential back patients. It wasn't easy it took many call, and finally a stand-off in his waiting room. Sorry to vent, but like I was told you could come into the SS office in an Iron Lung, but if you don't have the medical records to back it up, you'll not win your case. In searching for disability, there is also a site which tells you which health problems when combined will equal disability. I'll look for it. Guest guest Posted November 7, 2008 Report Share Posted November 7, 2008 Dear Opal, After getting social security disability you can only make $940.00/mo or they will take your disability away.After you have been on disability for one year you can be on a " trial period " where they will watch you for a total of 9months during which you can make anything but if you go over that time,they can again,snatch it away...crazy rules but it is what it is! I am in that " watch period " right now but I stand to loose everything if I don't lower my hours before my time is up or just quit. I hope this helps..I went through a lot to learn about this..SS is not very forthcoming .f..I also sought the help of an attorney who confirmed this information.Just be careful of that year's period before you can work. Guest guest Posted November 7, 2008 Report Share Posted November 7, 2008 Hi Opal, While I'm not on social security, I do work in a benefits department and I'm familiar with the rule regarding any occupation. It may be best explained by an example. If a distributor of soda hurts his back and it prohibits him from running his route, he still may have the experience and qualifications to train other drivers. The terms " any occupation " typically means a job for which your educationally qualified for or have experience for. I'd say that people with severe arthritis would not fall into the category of " any occupation " because part of the reason you're not able to work is because i. you're in pain ii. you have a slow start in the morning iii. you require narcotic pain relief which impairs your ability to think clearly or perhaps drive v. you need to be treated regularly by doctors... etc. Hope that helps.  Quote Link to comment Share on other sites More sharing options...

I would strongly urge you to go to the SS website, if you haven't already. They list all of the conditions that they consider. Being obese is even in there. They outline the criteria that they use to evaluate a disability. Such as, not being able to walk a city block, ability to concentrate, etc. When I was to the end of my rope, I checked it out and found that there were many ways I qualified. My SS disability went through in only four months. I will add that you must have good medical documentation and proof such as xrays, emg. I believe you will be denied because if you are working then you must be able to work. (There thinking not mine.) You cannot do the work you have been doing and need to do the ticket to work after your approved for ss. Focus on getting approved and worry about the ticket to work and earning after approval. You will get overwhelmed and confused if you don't. There are social security advocates in every state, I can't remember if they are only for those currently receiving benefits or not. I had to quit work before I applied. I got approved the first time around. I was approved after 4 months but you cannot start to get paid until 6 months. You can also apply for SSI that could help during the first six months and beyond. SSI is through the state and you can apply at your SS office or state department of human services. Guest guest Posted November 8, 2008 Report Share Posted November 8, 2008 I'm in Alaska, but moving to Wisconsin before the end of the year. I'm only 33, but I meet the criteria under inflammatory arthritis. I feel so unproductive, and I want to be able to work, but the truth is that my work attendance and performance are both impacted by my PA. I hadn't realized until I did the screening questionnaire on the Enbrel website quite how bad it really was. Denial is NOT just a river in Egypt!!  Right now I'm just taking methotrexate, and my P and stiffness have improved quite a lot. The pain is still there, my range of motion isn't good and I have lost muscle strength in my right arm and leg, which are far more affected than my right. This week new x-rays showed some ankylosing spondylitis in my upper and mid back, plus arthritis in both hip joints.  Opal Quote Link to comment Share on other sites More sharing options...
