I guess I have now passed one of the " rights of passage " with RA. I was turned

down by SSDI for permanent disability. I was kind of expecting it, but was

hoping for a miracle - not to have to go through an attorney for the process.

Anyway, I now need to find an attorney who specializes in SS disability in

Southern California. There are, of course, lots of them advertising on TV and on

the web, but was wondering if anyone here had any exerience, good or bad, with

any disability attorneys in Southern CA. If so, I would greatly appreciate the

input - I have no idea how to go about choosing one.

Good Morning ,

I too am going through the fight with Social Security for SSDI.  In addition to

RA, I also have Cardiovascular issues, Diabetes, Sleep Apnea, Polycythemia (A

rare blood disorder), and Hypertension.  I was also turned down the first time

or the initial filing.

At the point where you are turned down the first time is when you need an

attorney.  The way mine explained the game so to speak is, after the initial

decline, your attorney would refile the request.  After another 4 to 5 months

it

is declined the 2nd time.  At that point your attorney would file for a hearing

before an Administrative Judge.  At the hearing before the Administrative Judge

is where almost all SSDI is approved.

Just to try and set your mind at ease, the fee charged by the attorney is set by

Social Security.  The information I had from my attorney is the fee is either

25% of backpay Social Security owes you  or $5200.00 whichever is less.  By

backpay you started accumulating SSDI when you first applied.  So when approved

Social Security has to backpay you to the original date of the 1st application.

I would say my attorney, but he is local to the State of New Mexico, so that

would be no help in Southern California.  Just as a reference I am at the stage

of waiting for the hearing before the Administrative Judge.

I don't know how things have changed in 20 years but I did all these steps

myself. I only had help from a person from the hospital in wording my

statements in the initial filing. After that, I was on my own. I went to the

Administrative Hearing armed with a calendar documenting each day's

happenings and pain levels, and family members that were providing my care

as witnesses. I was mostly bed-ridden during that time, but drove us to the

hearing and admitted it to the judge. I had a hard time with the attorney

getting a big payday just for filling out papers I could do myself. I'm very

stingy if you can't tell, and would do the same all over again if necessary.
