Re: how do you communicate with your employer?

Hi ,

I'm just wondering, are you on any meds now and if not, why can't you take a

new DMARD till Oct? Would being on prednisone till Oct help, if you're not

already on it? I'm not a fan of it but it seems that you need to stay here

till Oct for financial reasons so would that help?

I am in a similar boat. I missed 1 day due to a flare up where I could barely

move, the rest are due to Dr. appts, or sicknesses due to the side effects of

medicine. EVERY day I am out, I get a doctor's excuse, I get excuses for Dr.

appts, I even got my Dr. to write me a letter stating that the meds I'm on could

make me sick and unable to attend work from time to time. I don't qualify for

FMLA for another few months...so it is scary! I wish I had more advice for you.

Good Morning .

I am located in TN as well and suspect that my employer is treating me less than

equal based on my RA. On flare days, when I must miss work, I get borderline

harassing comments from my supervisor. The best advice that I have been able to

ascertain is to document everything related to medical care, missed work, and

any comments or reactions from your employer. Also, I have researched my rights

through the ADA website and the JAN - http://askjan.org/ (Job Accommodation

Network). This is a wealth of information. It is a scary thing. I also have

contacted some disabilitiy lawyers just to ask questions, but they don't help

until you have been discriminated against or are applying for social security

disability benefits. At least this has been the information I received.

I hope this helps, although I'm not sure I really have a handle on how to deal

with this difficult issue. I am just trying to educate myself and document

everything in case I need it. Good luck. What part of TN are you in? I'm in West

according to the unempoyment rules they can not fire you for a medical

condition. If they do this they can be fined. I would A. communicate with your

dr to get a letter stating about meds making you sick and so forth, I would also

talk to the human resourses dept within the school and not to this evil

supervisor of a woman who doesn't seem to understand. According to the ADA you

do not have to disclose your disability it is against federal law to

discriminate in that way which sounds like what is going on with her. here is

I hope this is informational enough to hold on to your job. I finally found a

new job and work directly with individuals with disabilities find jobs in the

I would read up on the Americans with Disabilities Act (ADA). See if any parts

of it apply to you, then inform her that you do have certain rights.

This is very interesting thanks:

Lets say you do have a letter. Lets say your meds/RA make you sick once or

twice a month, een if you have unlimited sick time at work, or one day a month

and you use it, eventually can your employer force you to claim disability? Can

they push you out?

You need to talk to the EEOC - U.S. Equal Employment Opportunity Commission

and file a complaint.

File a complaint online here:

or find a field office:

http://www.eeoc.gov/field/index.cfm

They take complaints very seriously and will even prosecute companies in

federal court for violations if necessary.

They can help ensure your not fired and may also deal with the salary issue,

or may ask the your state department of work force development get involved

to determine if they are in compliance with the law in terms of how they are

handling salary vs hourly.

An employer can not force you to claim disability. They can however find other

reasons to get rid of you, case in point in what happened to me in March. I was

accused of pyscologically abusing a client with disabilities so they decided to

suspend me until farther investigation. I then was let go even though they

could not prove anything. If the issue of using your sick time and so forth has

become an issue with the supervisor then I would go through the chain of command

starting with the director and if nothing was done there then move up to the HR

department to see if something could be worked out. I have actually gone as far

as the CEO of a company when this has happened to me. I hope this helps. If at

the point the HR department does not help the situation then I would contact the

EEOC. I'm actually helping a friend now get information together for a blog

about employment, disability laws and what to do if something happens.

Hi ! I'm south of Nashville.

@- The company I work for is a chain of vocational schools. We have no

HR department! So my supervisor, then the owner, is my chain of command. The

owner has a hair trigger temper and has been known to fire people for merely

asking the wrong question. I'm director of a department and it is very hard to

find and keep good instructors anyway. It's even harder after they begin

receiving the ranting emails about this and that from that from the owner and

her people.( who learn their behavior from her.)

It's not an ideal work situation, but I love my students. Many of them have

lupus, RA, Fibro, etc and have looked to me as a role model. I feel like I

quit, I'll be sending them the message that " No you won't be able to do this... "

Right now, it's just he students that keep me there. I have a commitment to a

certain class that will graduate in December. I am just trying to hang in there

until then...enough time for them to get out and get their licenses and for my

family to be back in black. But honestly, I wish there were more protection for

workers in TN.

Here's the situation with the DMARD: I went off Orencia and tried

Rituximab. It did not work for me--bummer because it seems to work well for

everyone else. Because Rituxan is a twice a year drug, you soonest you can

get any other DMARD is 4 months after your last dose. So I have to wait

until October to get anything else.

I travel to Nashville frequently for business.

Isn't interesting that you work with children who struggle with a disability and

your supervisor is not understanding about your own struggles? We are in the

same boat there. The company I work for supports adults with developmental

disabilities, but are not understanding if their employees deal with the same

type of issues. Many of our clients are in wheelchairs, use walkers and have

medical disabilities. There is always the fear of getting sued that drives what

companies do and don't do for their employees, which is not something I am

worried about. I love my job and would like to keep it as long as I can. If I

need accommodations to do this, then I should be provided these. It just adds to

my sress level, and you know what that means for pain and FLARES!
