Dear Citizen for Health,

Last week we notified you that S. 510, The Food Safety and Modernization Act, overcame a necessary hurdle on the way to a final vote in the Senate when Senators voted 74-25 in favor of cloture. (All Democrats voted in favor, as did a significant number of Republicans). Thank you to all of our supporters who sent an email to their Senators urging them to reject cloture.

Send a letter now urging your Senators to vote "NO" on S. 510 unless the bill is amended (see below).

Shortly after our alert the bill's sponsors agreed to a slightly modified version of the Tester-Hagan amendment protecting small farms and distributors from S. 510's overreaching provisions better suited for big agribusiness and the large-scale operations to which recent food safety problems have been attributed. A new effort to invoke cloture on the amended bill failed due to arguments over allowing Senator Tom Coburn (R-OK) to submit an amendment on earmarks, so now consideration of cloture on the amended S. 510 has been postponed until the Senate returns on November 29.

Agreement on the Tester-Hagan amendment is good news, but it doesn't go far enough to alleviate all of our concerns with S. 510. Among the problems that have yet to be addressed are what constitutes "reasonable" probability that the use of or exposure to an article of food will cause serious health consequences, and language that could sacrifice the sovereignty of our internal laws and regulations. We can still stop S. 510, and we at Citizens for Health will continue to monitor every inch of the bill’s progress, keeping you updated at every stage. The bill must pass the Senate and then be reconciled in committee with the House version before it can be signed into law. This will not happen overnight, and it gives us further opportunity to ensure that our concerns are addressed and the bill amended accordingly. Here's our plan for the next few weeks:

We will muster our nearly 100,000 supporters to oppose the bill's passage in the Senate.

If it passes, we will put pressure on the conference committee assigned to reconcile the House and Senate versions.

If our concerns aren't addressed in committee and it passes both houses we will demand that the President veto S. 510. Throughout the process we will make it clear that our coalition is prepared to take the fight into the next Senate if necessary, and that lawmakers will pay electorally in 2012 if they continue to support this industry bill.

The collective power of concerned citizens making their voices heard has moved mountains – one need only look back to the passage of DSHEA for proof – and it will take all of us working together to win again.

Contact your Senators now about S. 510 and tell them "fix it, or reject it"!
