thousands of children with lifelong disabilities. That is what is happening in the " vaccine court " , a special court that is part of the United States Court of Federal Claims.

" Vaccine court " was established in the 1980's as a tort reform measure that was supposed to make it easier for children who have suffered vaccine injuries to obtain just compensation while giving legal protection to the vaccine manufacturers.Congress established a short time period for filing claims: claimants are required to file their claim within three years of the onset of symptoms of their vaccine injury. Contrast this short period with the time period allowed for children bringing claims in most states for personal injuries of other types – children can bring claims until they are 21 years of age - and the enormity of the change becomes apparent. Add to this the fact that it is not always clear when some vaccine

injuries occur – most pediatricians do not recognize the signs of neurodevelopmental disorders such as " autism " nor do they even recognize that autism may be the result

of a vaccine injury. The outcome is that many parents of injured children never knew that they had a claim. In some cases their right to bring a claim evaporated before parents could have legally filed one – an absurd legal circumstance that requires change. The ‘National Vaccine Injury Compensation Program Improvement Act of 2008’ remedies this and other inadequacies of the current law by doing the following, among other reforms:Extending the time period to file claims to 6 years and giving all claimants a two year window to file claims even if they were previously barred by the three-year limitationProviding for

interim compensation for attorneys representing vaccine injury claimants – under the current law attorneys have been working for five years or more without any compensation,

whatsoever.Making the formula for calculating just compensation for injured children fairer and raising the maximum limits for such awardsProviding for better community representation on and accountability by the administrators of the vaccine injury compensation program Read the bill here: http://www.govtrack.us/congress/billtext.xpd?bill=h110-6391Send a Message Using the Autism Action Network's
