I too have wondered this... but never tried for fear of being audited. LOL!! We

have a diagnosis of autism but recieve no state benefits as my husband makes

just too much.

There are a couple of exemptions you can take you just have to make sure you take the right one : i.e. One for disabled taxpayer, one for disabled child over 13, etc. and deductions that can be taken due to diagnosis. SSent from my iPhone

I believe you need to be on disability through SSI.

we've been audited several time cause back in the day when i was working, spent thousands on therapy and bio medical interventions, etc. was sort of a red flag to irs. however, our tax atty had us get a ltr from my son's developmental ped stating he is autistic and is in need of services etc. they accepted this.

It was my understanding that medicaid waiver does waive income requirements in

every state. We just got my son on this in NY. We would never be approved

based on income. In NY there is no waiting list for this. There is a ton of

paperwork and it took about 6 months to go through multiple rounds of approvals.

With medicaid, we have a secondary insurance that covers copays on meds and

labs, dr and hospital visits that are in network, all therapy services that we

would have to pay for out of pocket, diapers, and respite (which is

babysitting.)

One more thing, did you actually apply for medicaid itself at the Social

Security office? Perhaps the hold up is one of the earlier steps, like getting

a non-medicaid service coordinator to help you apply.

We had to first apply to our local LIDDSO which is part of the Office for People

with Developmental Disabilities to get approved for services. Then, we had to

get a non-medicaid service coordinator. This coordinator helped us do all the

paperwork and steps necessary to get approved for the " waiver " and then apply

for medicaid. Medicaid itself only took a month to get approved based on the

waiver of financial need.
