This was discussed at the last ESE advisory meeting. There is a Federal Suite

against the District for systematically denying ABA as a teaching method.

This is the discovery phase and the attorneys and staff that will have access to

IEP's are bound by court order to keep all information confidential except with

permission of the court.

It sounded at the advisory meeting like the District would like us to be

concerned re the confidentiality of our kids IEP's, but I don't believe thats a

real issue.

We were told Broward Schools doesn't provide ABA too, so they are welcome to

look at my kids IEP's under the given conditions all they want.

The attorneys that are part of the lawsuit will be able to access your child's file (ieps etc) unless you contact them with a "no". They are only allowed to review them in a restricted area and cannot be taken out or reviewed by anyone else. There are very strict guidelines for their access. I am hoping that they will find enough out of the records to make them comply instead of all these due processes that many of us have had to undergo.

Oh, and I believe whether you state otherwise or not regarding permission for

access to your childs IEP's, the attorneys will have access. That is what the

Court is ordering. What the District is offering is an opportunity to state your

displeasure with said access.

Oh, and I believe whether you state otherwise or not regarding permission for

access to your childs IEP's, the attorneys will have access. That is what the

The letter went out to all parents with children classified as

autistic since year 2000. The lawsuit alleges that the School District as a

policy has denied requests for ABA and has never considered ABA as an option. The

ultimate goal would be to have ABA available in all schools in the State of

Florida. In a way every time someone on this list discusses their child's

specific problems they violate the idea of privacy. Do you really care who

reads your posts? In the lawsuit confidentiality is maintained.

Steve, I think you explained it perfectly. I think in the

Meeting you would expect the privacy issue to come up. But I think if you read

the letter and understand the purpose of the letter you have to ask yourself

what is the privacy concern. These records are protected. The attorneys are not

going to take the records and go to the top of a tall building and empty the boxes.

And a parent might ask himself what do they think of having ABA in your school.

They are also welcome to look my kid information since I spent 3 years looking for this and It was like I was talking about something impossible and It will never happen in the view of the school teachers, advisors, insurances, etc Now the insuraces are obligated to provide ABA therapies under certain conditions. Completely out of logic that schools do not provide teaching to Autistic children based on ABA programs. Same as looking for a specific treatment and just get tylenol. Jeannette

I was wondering the same thing. We recieved the letter yesterday. RE: Lawsuit against Broward County School Board

The letter went out to all parents with children classified as autistic since year 2000. The lawsuit alleges that the School District as a policy has denied requests for ABA and has never considered ABA as an option. The ultimate goal would be to have ABA available in all schools in the State of Florida. In a way every time someone on this list discusses their child's specific problems they violate the idea of privacy. Do you really care who reads your posts? In the lawsuit confidentiality is maintained.

Actually it is not just IEP's.

Oh, and I believe whether you state otherwise

or not regarding permission for access to your childs IEP's, the attorneys will

have access. That is what the Court is ordering. What the District is offering

is an opportunity to state your displeasure with said access.
