Actually it is not just IEP's.

Oh, and I believe whether you state otherwise

or not regarding permission for access to your childs IEP's, the attorneys will

have access. That is what the Court is ordering. What the District is offering

is an opportunity to state your displeasure with said access.

I work for an attorney and took the paperwork to him today. He looked it over and said it would be in my best interest to let the records be obtained. My daughter has been denied so many services that I withdrew her from the school system. My attorney happens to know the plaintiff's counsel. So we gave him a call and I told him that whatever I could do to help him was fine with me. Mr. Pyper was so nice and understandiing. He has triplets that are 9 and all on the spectrum. I hope something good comes of this to help those that need it.

This was discussed at the last ESE advisory meeting. There is a Federal Suite against the District for systematically denying ABA as a teaching method.

This is the discovery phase and the attorneys and staff that will have access to IEP's are bound by court order to keep all information confidential except with permission of the court.

It sounded at the advisory meeting like the District would like us to be concerned re the confidentiality of our kids IEP's, but I don't believe thats a real issue.

We were told Broward Schools doesn't provide ABA too, so they are welcome to look at my kids IEP's under the given conditions all they want.

It is about time something is done. In 1984 I attempted to get therapy etc. for

my son via Broward Schools and I was told he isn't disabled enough although he

is in the moderate range of PDD-autism disorder. I home schooled for 7 years and

private paid for therapies, etc., then put my son into private schools to get

what he needed. The people running the Broward Schools don't care about the

kids, they care about the bottom line on the budget and protecting their jobs.

Hi:

They are also welcome to look my kid information since I

spent 3 years looking for this and It was like I was talking about

something impossible and It will never happen in the view of the school

teachers, advisors, insurances, etc Now the insuraces are obligated to provide

ABA therapies under certain conditions. Completely out of logic that schools do

not provide teaching to Autistic children based on ABA programs. Same as

looking for a specific treatment and just get tylenol.

Steve, I think you explained it

perfectly. I think in the Meeting you would expect the privacy issue to come

up. But I think if you read the letter and understand the purpose of the letter

you have to ask yourself what is the privacy concern. These records are

protected. The attorneys are not going to take the records and go to the top of

a tall building and empty the boxes. And a parent might ask himself what do

they think of having ABA in your school.

I also received this letter. I called one of the attorneys to find out more

information. I was going to file a motion to keep Broward from releasing my

daughter's records, but after speaking to him (he is actually one of the

plaintiffs in this case), I will not file the motion. I told him if he needed

the file to prove/win his case, he could have it. But if it was going to help

Broward county, then I would file to have it repressed. I feel ok, after

speaking with him and hearing his story, that we need to give him all the help

we can.
