I found it, thxSent from my iPhone

Hi all I am trying to find the section of IDEA that discusses the criteria for suspension of child with a known disability.

Going back to undergrad, which was a while ago, I thought that if a child's behavior was due to/related to the disability the school was not able to suspend the child unless it involved illegal drugs and/or weapons.

I would like to site it for an assignment for grad school but can't find the actual section.

I don't remember exactly where either. Including:

6A-6.03312 Discipline Procedures for Students withDisabilities.

(d) For disciplinary changes of placement, if the behavior that gave rise to the

violation of a code of student conduct is determined not to be a manifestation

of the student's disability, the relevant disciplinary procedures applicable to

students without disabilities may be applied to the student in the same manner

and for the same duration in which they would be applied to students without

disabilities, except that services consistent with subsection (5) ofthis rule

must be provided to the student with a disability.
