So this was changed? i thought it passed. you mean to say that the

HB1505 bill that passed no no longer has the " ...permits students to

recieve instruction & services at site other than physical location of

school... " in it anymore?

" ...HB1505 - M. McKay Scholarships for Students with Disabilities

Program: Revises student eligibility requirements for participation in

scholarship program; authorizes students who are eligible to enter

kindergarten to receive M. McKay Scholarship; provides eligibility

requirements for student identified with developmental delay;

authorizes students who were enrolled & reported by school district for

funding during any prior year FEFP surveys to receive scholarship;

authorizes Commissioner of Education to deny, suspend, or revoke

private school's participation in program for certain acts or omissions

by owner or operator; permits students to receive instruction &

services at site other than p hysical location of private school under

specified conditions.

Effective Date: July 1, 2010... "

& gt; & gt; Hello all,

& gt; & gt; HB1505 passed in the last session and is on Governor

& gt; & gt; his signature.

& gt; & gt;

& gt; & gt; 1505 expands the McKay Scholarship to Kindergarten kids as

well as

& gt; a few

& gt; & gt; other changes. We tried to reduce / eliminate the 1 year

& gt; requirement butit

& gt; & gt; got washed out of the Bill late in session.

& gt; & gt;

& gt; & gt; Regardless there are positive steps in the correct direction

with

& gt; & gt; and a call or e-mail to Governor Charlie asking him to pull

out his

I am sorry but yes, our Legislature stripped that language from the Bill late in

session.

The Bill does do some good things, but for the 4th year in a row the Legislature

refused to pass a hospital/homebound McKay option.

Below is the Bill as sent to the Governor:

http://www.myfloridahouse.gov/Sections/Documents/loaddoc.aspx?FileName=_h1505er.\

docx & DocumentType=Bill & BillNumber=1505 & Session=2010

A bill to be entitled 1

An act relating to education programs for children with 2 disabilities; amending

s. 1002.39, F.S.; revising 3 provisions relating to the M. McKay

Scholarships for 4 Students with Disabilities Program; authorizing students 5

who receive certain services under the Voluntary 6 Prekindergarten Education

Program to receive a M. 7 McKay Scholarship; authorizing the Commissioner

of 8 Education to deny, suspend, or revoke a private school's 9 participation in

the scholarship program if the owner or 10 operator of such school has operated

an educational 11 institution in this state or another in a manner contrary 12

to the health, safety, or welfare of the public; providing 13 factors for the

commissioner to consider in making a 14 determination; providing a definition

for the term " owner 15 or operator " ; conforming cross-references; amending s. 16

1002.51, F.S.; providing definitions for the terms 17 " disability " and

" specialized instructional services 18 provider " for purposes of the Voluntary

Prekindergarten 19 Education Program; amending s. 1002.53, F.S.; providing 20

that a parent may enroll his or her child in a specialized 21 instructional

services program for children who have 22 disabilities if the child is eligible

for the Voluntary 23 Prekindergarten Education Program; creating s. 1002.66, 24

F.S.; establishing specialized instructional services for 25 children with

disabilities; providing eligibility criteria 26 for such services; requiring

that such services be 27 delivered in accordance with certain standards;

requiring 28

& #61472;

that the Department of Education approve specialized 29 instructional service

providers; authorizing the 30 expenditure of funds for specialized instructional

31 services; amending s. 1002.71, F.S.; revising provisions 32 for the funding

of a child receiving specialized 33 instructional services to conform to changes

made by the 34 act; amending s. 1002.73, F.S.; requiring that the 35 Department

of Education adopt procedures for approving 36 specialized instructional

services providers; amending s. 37 1002.75, F.S.; requiring that the Agency for

Workforce 38 Innovation adopt procedures for enrolling children in and 39

determining the eligibility of children for the Voluntary 40 Prekindergarten

Education Program and paying specialized 41 instructional services providers;

providing an effective 42 date.
