I have NO idea what they are voting on now. I'm ashamed to live in the state I am and I'm glad I didn't vote for the senators from Maine that are in office. I agree with the poster who suggested naming the people who gave evidence against your son.It sounds as though the independent ed. psych may have been poorly propared and briefed - if her thoughts were along the lines revealed at Tribunal her report shouldn't have been used, nor should she have been called as a witness. I was looking up special school ofsted reports for nowrich and wasn't sure what 's school was called. Have you written down the points on which the LEA misled the Tribunal? could be grounds to get their decision quashed and perhaps get your costs, but I'm not sure on this point. I paid for indep edu psychologist whose report was excellent pro-ABA and he was upfront to say that it honest to admit BEFORE tribunal that would make no difference whether he attended or not as really Education system is designed to provide an education (LEA'S slitter how its delivered and at what pace) but LEA's don't provide the best and most suitable education for our children. He even admitted that LEAs education was so poor that really it would make no difference whether my son attended or not - one year down the line he is right. Spot on. SEN Children are sold short - if most got intensive ABA/VB, DT,OT SALT support like in America then the long term outlook for the children has been proven to be better. Trouble is MOST and indeed ALL parents in my area just accept the education system, cause no waves as long as the child is 'out of sight' 6 hours a day. You need to analyse the decision and check if any point of law to ask for a review. Otherwise if you 'accept' (sick!!) the decision, then put pressure on LEA to deliver - that what I am doing. REALLY FEEL FOR YOU. Guest guest Posted December 23, 2006 Report Share Posted December 23, 2006 hi vicky, my name is melissa sorry to hear your news a few things not sure if you know about, when i was fighting to got our lea to allow me to home teach my son shane using aba i contacted an organization called ispea they are an independant panel for special education needs they do provide a service where they will attend tribinal with you, but will give lots of advice on education law they know it back to front and gave me lots of quotes which i used to get the lea to agree to home ed, also one other thing i did was to download the national curriculum and write a report states how the aba program fulfills each goal on there, also there is a charity in somerset called bibic they do overall assesements to help children with special needs and provide ot/diet/speech therapy programs but they also have a ed phychololist who does reports for tribinals a friend of mine had one done and used it to get funding for her son who does aba, just a few ideas take a break have a great christmas melissaxx __________________________________________________ Quote Link to comment Share on other sites More sharing options...

A year later she is cheerful, happy, learning easily and open to new experien ces. In ss she was becoming more withdrawn and hysterical, more routinised, more fearful (much more), learning virtually nothing and spending her lessons colouring-in. If the lea head made statements at Tribunal which turn out not to be true (as ours did) then write it all down. Keep notes of everything anyone says to you. A contemporaneous note can be produced as evidence in court. Make notes, work out your best alternative and ask for it with reasons in a year's time. If you don't get it go back to Tribunal. This time no one will be able to tell lies about the lea provision. It took me ages to pull myself back upright after losing at Tribunal. I'm sorry. It's so horribly painful.
