Guest guest
For Immediate Release: O.S.E.A.Parents/client comes forward - 5 yr. old Autistic girl duct taped and tied to her classroom chair for a number of hours disclosed in Oklahoma city lawsuit accepted by the courts this week and filed near the end of last year. As the advocate for the child I can not release any further information in regards to this case as it is in litigation. Close to one dozen other parents in same district have filed similar suits according to our in house investigation and input from the parents themselves. If you are on my facebook I will be disclosing the entire suit in which nearly a dozen plaintiffs have joined in separate but related actions against the same school. Superintendent quoted by the O.S.E.A. today as stating " There's no law against us tying a child to a desk " . As well this large district is under investigation for medicaid fraud in the common illegal practice of billing medicaid on falsified claims or on children receiving services from those with less then the minimal standards set forth by Medicaid. Thank you to all teachers, para's, professionals, and other staff in schools and districts that do not practice such inhumane ways. More to come on the specifics. O.S.E.A. reports legal remedy already under 18 U.S.C. 245 in which penalties can include up to life imprisonment. Remedy is in place against such horrid acts against our children and should be used whenever possible. Here is the link: **The portion of Section 245 of Title 18 which is primarily enforced by the Criminal Section makes it unlawful to willfully injure, intimidate or interfere with any person, or to attempt to do so, by force or threat of force, because of that other person's race, color, religion or national origin and because of his/her activity as one of the following: * A student at or applicant for admission to a public school or public college * A participant in a benefit, service, privilege, program, facility or activity provided or administered by a state or local governmen * Please see: http://www.justice.gov/crt/crim/245.php **The offense is punishable by a range of imprisonment up to a life term, or the death penalty, depending upon the circumstances of the crime, and the resulting injury, if any. - en quote U.S.D.O.J. - C.R.D.
