Council supports Rep. Hukill's

Bill.

On Wednesday, January 14, 2010, over

two dozen individuals met on the fourth floor Capitol rotunda to show

their support for House Bill 81, a proposal that would regulate the use,

prevention, and reduction of seclusion and restraint on students with

disabilities in public schools.

Representative Dorothy Hukill, who

sponsored the bill, parents, and representatives of advocacy groups,

explained why the bill is needed. They focused on that section of the

bill that lists the various instances when manual physical restraint

could be used. Such instances include emergency situations when there is

imminent risk of serious injury or death to the student or others.

The bill places restrictions on the

use of manual physical restraint, and prohibits use of manual physical

restraint by school personnel who are not trained & certified to use

district-approved methods for applying restraint techniques.

Additionally, it prohibits school personnel from placing students in

seclusion, provides requirements for use of time-out, and requires

schools to prepare incident reports after the occasion of student

restraint. The bill also requires development & revision of school

district policies & procedures relating to seclusion and restraint of

students.
