I would recommend you visit this site for more information. http://www.silicosis-net.org The problems in a suit are many including (1) funding litigation, (2) proving direct correlation (3) proving negligence on employer's part (4) proving employee shouldn't have done anything different and (5) proving responsibility not that of mask manufacturers where applicable. Guest guest Posted July 30, 2008 Report Share Posted July 30, 2008 Dear NLW, I am currently suing my former employees but as time goes on ( 2 years now) I am losing hope that I will ever even get to court. I am a former school teacher and I am sure I got PF from the moldy portable classroom I was in- the two teachers who worked in the class before I did also have sarcoidosis and advanced pulmonary fibrosis. They have supoened my health records from the 1980's on, sent me to two different medical examiners, went through all my work files and even entered for court records my marrriage counseling history! I am getting discouraged and not sure whether the time and emotional toil is worth it. Not sure if others have tried. Spend whatever they have to on lawyers hoping to kill your case because of the cost of making it. Argue there was no way for them to know. Argue the real culprit is the supplier of the classroom. Argue that we don't know the cause of PF and that yours and the others are simply coincidences, that they haven't had problems with others or students. Get experts to support their argument. Get your expert to admit that he can't be sure that was the cause. Then ultimately if they ever get close to actually having to fight it in court, before a jury where they might lose, they will offer some sort of settlement on the condition they don't admit any guilt and you can't discuss the settlement with anyone. Clearly, we know now the danger of mold and three teachers in a row defies the odds of coincidence. They could have and should have offered to have at least pay you for the remainder of your projected career (actual damages but no punitive). That would have cost them less. I've been trying to figure out what to do financially since my diagnosis and it looks like a lawsuit wouldn't get me anywhere and just cause more stress than I already have . The company I worked for ( Revlon ) has billions of dollars on their side and I'd be dead and gone before it even went to court . I didn't stay on contact with any body I worked with there so I don't know how many of them are in my situation .
